Aunque, en teoría, todo el mundo defiende la libertad de expresión, en la Europa actual han aparecido nuevas cortapisas bajo la forma de leyes contra el “discurso del odio”. Con este concepto impreciso se intenta englobar expresiones que provoquen hostilidad y violencia contra personas por su pertenencia a ciertos grupos.Sin embargo, su aplicación práctica está sirviendo para penalizar e intentar silenciar ideas que desafían la ortodoxia políticamente correcta del momento. Cada vez más grupos intentan acallar la libre expresión de ideas que, a su juicio, consideran ofensivas para su identidad (étnica, sexual, de género, religiosa…). Calificarlas de “discurso del odio” es un modo de cerrar el debate sin discutirlas.Coleman estudia el origen y la proliferación de estas leyes en Europa. Su perspectiva jurídica se une a la exposición de casos en distintos países de periodistas multados, clérigos llevados a juicio, profesores castigados.Su análisis revela que las leyes contra el “discurso del odio” tienen una redacción imprecisa, con una gran carga de subjetividad, no requieren que lo que se pretende prohibir sea falso ni que haya una víctima concreta, solo defienden a ciertos colectivos y no a otros, muchas veces tienen carácter penal y se aplican de forma cambiante.Esta arbitrariedad puede causar más daño a la libertad que las ideas peligrosas que pretende combatir. Una genuina libertad de expresión implica que la gente pueda emitir opiniones que sean molestas para otros ciudadanos o para la opinión pública dominante. Pero precisamente por eso es necesaria la libertad de expresión.

The death of General Francisco Franco in November of 1975 ended thirty-six years of fascist-style dictatorship in Spain. The subsequent transition to liberal parliamentary government was remarkably smooth, particularly when compared to the recent difficulties experienced by other states, such as the former Soviet Republics and Eastern Europe. Ortiz traces Spain's success back to the development of a liberal tradition and a public sphere in the last decades of the 19th century during the Restoration period. He uses this era as a test case to demonstrate that liberal practices can develop even within a political situation where state institutions and the social infrastructure do not necessarily support them. Paper Liberals dispels the notion that Western Europe ends at the Pyrenees and argues instead that, while on the periphery, Spain should not be excluded from the mainstream of European history. Clarifying a period in contemporary Spanish history that has been largely misunderstood, this study underscores the importance of the Spanish example as a comparative model to the countries customarily thought of as the European center (Britain, France, and Germany). Ortiz examines the formation and expansion of liberal political culture during the Regency of Maria Christina from 1885 to 1902, and he details the pivotal role of the Spanish press, which dominated the public sphere of Regency Spain, as the vehicle for this remarkable transformation.
