The quantification of contractual money awards is a topic of both significant theoretical interest and immense practical importance. Recent debates have ranged from the availability of gain-based relief to the basis for principles of remoteness and mitigation. While these and other important issues, such as the recovery of damages for non-pecuniary loss, are touched upon, the book's principal objective is to challenge the conventional interpretation of the principle generally acknowledged to govern this area of the law, which Parke B famously laid down in Robinson v Harman. According to this conventional interpretation, the objective of all money awards given in accordance with the Robinson v Harman principle is simply to 'compensate' the promisee for the 'loss' that can be attributed to the promisor's failure to perform as promised. After challenging this orthodoxy, Dr Winterton proposes a new understanding of the Robinson v Harman principle, which draws an important distinction between money awards that substitute for the performance promised and money awards that aim to make good certain detrimental factual consequences that can be attributed to a promisor's breach. In exploring the significance of this distinction, the different principles underpinning the quantification and restriction of each kind of award are explored in addition to some important theoretical issues such as the effect that the occurrence of a breach has on the rights generated by contract formation. The book's unifying objective is to outline a coherent picture of the law of contractual money awards. It will be of interest to judges, practitioners and academics alike. Pursuant to a legislative requirement, GAO reviewed the Army Corps of Engineers' contracting procedures for civil works projects to determine whether: (1) bidders competed fairly for Corps construction contracts; (2) Corps field offices uniformly applied contracting procedures; and (3) the Corps needed to improve its contracting procedures. GAO found that: (1) the seven Corps districts it visited achieved full and open competition for 500 civil construction contracts awarded in 1986 and 1987; (2) the Corps awarded contracts totalling $255 million to small businesses under mandated small business set-aside programs, and $561 million in unrestricted contracts to both large and small businesses; and (3) there were no sustained protests of restrictive specifications in 54 civil construction contract protests filed in fiscal years 1986 and 1987. GAO also found that: (1) none of the 130 contractor representatives it contacted who did not compete for construction contracts indicated that they felt that the Corps' solicitations were restrictive; (2) although none of the representatives indicated that the Corps' recordkeeping requirements kept them from competing, 15 indicated that the requirements were either voluminous, costly, unnecessary, or redundant; and (3) the Corps contracted out almost all general construction under its civil works programs and about 40 percent of its civil engineering work.

Government contracting is plagued by nefarious, amateurish, and criminal behavior. By awarding government contracts to corporations as compensation for lavish gifts and personal favors, the United States government fails to serve the public interest effectively and honestly. William Sims Curry identifies and categorizes multiple deficiencies in how government contractors are selected, and proposes how reforms can be instituted.This book is based on extensive research. Curry sifted through two years worth of contractor claims maintained by the Government Accountability Office (GAO) regarding improper behavior of federal government agencies during the contract award process. He identified additional government contracting failures through review of media stories, inspector general reports, court cases, and press releases by government investigatory agencies.Much of this abuse originates from the mandated but ineffective practice of color coding rating proposals and a subjective ratings system. Curry proposes replacing the current practice with a scoring system that weighs contractor selection criteria according to the government's needs.
