Desde hace varias décadas, el ritmo frenético de la globalización ha traído consigo un auge en la Contratación Internacional. Sin embargo, al igual que en los negocios nacionales, en los contratos internacionales existe multiplicidad de cláusulas contractuales. Con el fin de guiar a los actores en estas interacciones, el presente libro tiene como objetivo fundamental desentrañar las vicisitudes propias de las "cláusulas de uso frecuente en los contratos internacionales". En este orden de ideas, este texto aborda detalladamente cláusulas complejas como la de Hardship, cláusula de confidencialidad, el pacto arbitral, cláusula de ley aplicable, cláusulas abusivas, entre otras. De esta manera, el Departamento de Derecho de los Negocios de la Universidad Externado de Colombia conjuntamente con la Subcomisión de Prácticas Mercantiles de la Cámara de Comercio Internacional vuelven a aunar esfuerzos para generar un contenido requerido por la práctica empresarial, manteniendo el rigor legal. Es así como bajo la dirección de la doctora Adriana Zapata y la coordinación de los doctores Gustavo Piedrahita y Luis Alfonso Gómez fueron convocados expertos de primer nivel en cada una de las materias desarrolladas.

Este trabajo aborda el tratamiento que en el ordenamiento jurídico colombiano y en la doctrina y jurisprudencia patrias se le debe dar a la responsabilidad civil profesional de las sociedades fiduciarias, derivada de sus actuaciones como fiduciarios, bajo un prisma que está dado por las claves interpretativas que nos ofrecen tanto los textos y la propia tradición jurídica anterior a la redacción del Código Civil como las actuales directrices del Derecho constitucional en punto a la libertad de empresa en el Estado social de derecho y del derecho de obligaciones y contratos al servicio de un tráfico comercial bien distinto al regulado por las fórmulas insertas en el Código Civil. Así, con un enfoque dogmático y práctico, procuramos que la determinación de la naturaleza y características de la responsabilidad civil de las sociedades fiduciarias tengan una definición precisa en términos jurídicos, habida cuenta que la doctrina y la jurisprudencia patrias no han sido muy prolíficas en la determinación del contenido y alcances de la culpa como criterio de imputación de la responsabilidad civil del fiduciario, amén de que no se les ha prestado la atención debida al tema de la diligencia y a las figuras del buen padre de familia y del artifex, con miras a determinar la procedencia de sus aplicaciones en la contratación fiduciaria.

Who shapes the European Union's policy towards Latin America? How has this EU policy modified individual member states' relations with the region? A “dissident of the gender-sex binary system” reflects on gender transitioning and political and cultural transitions in technoscientific capitalism. Uranus, the frozen giant, is the coldest planet in the solar system as well as a deity in Greek mythology. It is also the inspiration for uranism, a concept coined by the writer Karl Heinrich Ulrich in 1864 to define the “third sex” and the rights of those who “love differently.” Following Ulrich, Paul B. Preciado dreams of an apartment on Uranus where he might live beyond existing power, gender and racial strictures invented by modernity. “My trans condition is a new form of uranism,” he writes. “I am not a man. I am not a woman. I am not heterosexual. I am not homosexual. I am not bisexual. I am a dissident of the gender-sex binary system. I am the multiplicity of the cosmos trapped in a binary political and epistemological system, shouting in front of you. I am a uranist confined inside the limits of technoscientific capitalism.” This book recounts Preciado's transformation from Beatriz into Paul B., but it is not only an account of gender transitioning.
