Although individuals or companies can pursue civil remedies to address violations of their intellectual property rights, criminal sanctions are often warranted to ensure sufficient punishment and deterrence of wrongful activity. Congress has continually expanded and strengthened criminal laws for violations of intellectual property rights to protect innovation, to keep pace with evolving technology and, significantly, to ensure that egregious or persistent intellectual property violations do not merely become a standard cost of doing business for defendants.

The United States has created enforceable rights in "intangibles" that are known as intellectual property, including copyrights, trademarks, and trade secrets. Copyright law provides federal protection against infringement of certain exclusive rights, such as reproduction and distribution, of "original works of authorship," including computer software, literary works, musical works, and motion pictures. 17 U.S.C. 102(a), 106. The use of a commercial brand to identify a product is protected by trademark law, which prohibits the unauthorized use of "any word, name, symbol, or device" used by a person "to identify and distinguish his or her goods, including a unique product, from those manufactured or sold by others and to indicate the source of the goods." 15 U.S.C. 1127. Finally, trade secret law prohibits the unauthorized disclosure of any confidential and proprietary information, such as a formula, device, or compilation of information but only when that information possesses an independent economic value because it is secret and the owner has taken reasonable measures to keep it secret. 18 U.S.C. 1831, 1832.

What is intellectual property? Should copyright laws be modified to accommodate new ways of transmitting information? The debate over such questions has reemerged with the growth of the Internet and other means of electronically storing information. Over 600 articles written from 1900 through 1995 are fully annotated in this bibliography. The citations cover a wide range of material, from humorous anecdotes in popular magazines to scholarly discussions in academic journals. The entries are divided into three parts: the money trail; the detection and proof of violations and the punishment of offenders; and defending one’s property. A lengthy introduction first details how the concept of intellectual property came into being and then focuses on how governments and other entities deal with the issue.

John Gurnsey has reviewed all forms of copyright theft, from commercial to domestic, gathering the experiences of a wide range of organizations across book and electronic publishing. Book, electronic, database, audio, video, games and multimedia publishing are all considered along with the question of whether existing laws can effectively serve such a rapidly changing industry. Copyright law is an extremely complex area: this book is about the abuse of it, rather than the law itself. In helping publishing companies understand more about copyright theft, it might help them to avoid it in at least some of its forms.

An understanding of the changing nature of the law and practice of copyright infringement is a task too big for lawyers alone; it requires additional inputs from economists, historians, technologists, sociologists, cultural theorists and criminologists. Where is the boundary to be drawn between illegal imitation and legal inspiration? Would the answer be different for creators, artists and experts from different disciplines or fields? How have concepts of copyright infringement altered over time and how do such changes relate, if at all, to the cultural norms operating amongst creators in different fields? With such an approach, one might perhaps begin to address the vital and overarching question of whether strong copyright laws, rigorously enforced, impede rather than promote creativity. And what can be done to avoid any such adverse consequences, while maintaining the effectiveness of copyright as an incentive-mechanism for those who need it?

conferred on the original copyright owner. There are manyissues involved in the copyright infringement disputes. The copyright owners need to prove the access of aninfringer to copyrighted material in order to bring a legalaction. Apart from proving the access, the copyright ownerought to establish the fact that there was a substantial partof copying done by the infringer resulting in economic lossto the owner and a gain to the infringer. In the presentcyber scenario, technological advances have posed legalchallenges to copyrights.
