Despite the growing consensus that corporal punishment violates children's fundamental human rights - the respect for human dignity and physical integrity - most of the world's children are still subjected to assault. Against this background, this book discusses and compares the characteristics of corporal punishment of children as laid down in international documents, such as the UN Convention on the Rights of the Child, the International Covenant on Civil and Political Rights, and the Convention against Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment. The book also looks at regional documents, including the European Convention on Human Rights, the African Charter on the Rights and Welfare of the Child, and the African Charter on Human and Peoples' Rights. Each chapter starts with a short introduction, followed by an examination of a definition of corporal punishment, and shows the role of expert bodies who are monitoring the implementation and processes of standard-setting. Therefore, a distinction is made between the prohibition in alternative care settings, schools, and by parents, which leads to the question: "Is corporal punishment of children by their parents prohibited?" The second part of the book deals with a comparative study, analyzing the implementation of the previously discussed documents in the UK, Zambia, South Africa, and Belgium. Hence, the question is "How does the State implement the provision of the prohibition of corporal punishment in domestic law?" which is followed by the question "Has the specific State prohibited corporal punishment of children by their parents?" The book ends with a conclusion in which the above-mentioned countries are compared with each other.

This Brief reviews the past, present, and future use of school corporal punishment in the United States, a practice that remains legal in 19 states as it is constitutionally permitted according to the U.S. Supreme Court. As a result of school corporal punishment, nearly 200,000 children are paddled in schools each year. Most Americans are unaware of this fact or the physical injuries sustained by countless school children who are hit with objects by school personnel in the name of discipline. The first two are international legal documents used in the protection of human rights: The United Nations Convention on the Rights of the Child (CRC) from 1989 and the European Convention on Human Rights and Fundamental Freedoms (ECHR) from 1950. The third focal point consists of an investigation into a specific area of jurisprudence of the European Court of Human Rights (the Court) regarding the protection of human rights of children: the phenomenon of the corporal punishment and abuse of children in the UK. This selection of verdicts of the European Court aims at portraying how the ECHR impacts on the child’s human rights in practice and how well the work of the European Court reflects the values enshrined in the CRC and also gain an understanding of how the two conventional systems might impact on the other. The third chapter investigates verdicts of the Court that have dealt with cases that derive from institutional settings (judicial corporal punishment and punishment in public schools). The fourth chapter will observe private settings, where cases of corporally punished children relate to the private sphere (e.g. punishment through parents). Beside, it is intended to give a short outlook on two selected cases where a matter of more general abuse of children was under judicial scrutiny. The dissertation concludes that both the CRC and the ECHR are characterised by a number of more or less serious flaws and drawbacks in relation to the protection of children’s human rights. The narrow textual scope of the ECHR and the significant weaknesses of the CRC regarding its implementation mechanism are two prominent examples. The paper suggests that in Europe, the trend of maximising the potential of the European Convention by combining the widely accepted, detailed standards on children’s rights set out in the UN Convention with the highly successful and influential system of individual petition and implementation should find its continuation and be strengthened even further.

One of the aims of the United Nations Convention on the Rights of the Child is to accord due recognition to the fact that 'the child, by reason of his phsyical and mental immaturity, needs special safeguards and care, including appropriate legal protection, before as well as after birth'. However, a question mark hangs over the extent to which 'special safeguards and care' can negatively impact on the rights of the child and result in discrimination against the child in the guise of 'his physical and mental immaturity'. This volume explores the extent to which children's rights are secured at the national level; and the reasons why children's rights have or have not been recognised and secured by various states at the level of domestic law. It also explores the difficulties inherent in the accordance of rights to children in order to ascertain whether they do in fact derive from the particular nature of children or whether they mask a reluctance of states to fulfil their domestic and international rights obligations to children, and whether such reluctance constitutes 'discrimination against children'.
