The new EU Procurement Directives reinforced the importance of sustainable development by facilitating the strategic use of public procurement to achieve broader societal goals and as such offer significant new opportunities for sustainable public procurement. The task of today is to better understand the continuously developing concepts of SPP, as well as to identify the drivers and barriers that promote or hinder its further implementation. This article firstly deals with the relationship between the concepts of sustainability, Corporate Social Responsibility (CSR) and public procurement. Secondly, as Denmark has been known as a pioneer in sustainable development, including implementation of it in public purchasing this article focuses on recent developments in the areas of CSR and sustainable public procurement in Denmark, and analyses relevant Danish Public Procurement Complaints Board decisions.

Unlike most researches, this one does not only concentrate on the effect of a single ESG-Score. Instead, it is a natural experience, analysing the impact of an exogenous event on a firm’s market value. More precisely, the influence of a law’s implementation to disclose sustainable belongings of a firm. The two countries that introduced aforementioned law were Denmark in 2009 and France in 2012. By using a Difference-in-Differences Approach, significant changes in market value for firm’s obligated to report within those countries are analysed and compared to other firms non obligated, listed in the STOXX Europe 600. The estimates suggest a significant negative influence on the market value for firms obligated to report situated in the post-intervention. Further, the negative influence increases with a complementary increase in delta ESG-Score. Those results suggest that a company should not suddenly abdomen itself to sustainability from one year to another. It is advisable to gradually address the matter in order to not negatively influence the market value of the company. Sustainable thinking is a movement of modern world society that can be noticed each passing day. When comparing the year of 2009 with the one of 2012, an increase in socially reasonable investment assets of 22 percent is noticeable. Besides, an ever-increasing number of people are joining environmental protest groups and pressure governments over the world to act. They want the government to, for example, force firms to produce more sustainable. Therefore, Corporate Social Responsibility (CSR) is becoming increasingly important in the daily business of a company. Many firms consequently responded by publishing a sustainability report each year and with that voluntarily report about environmental and social concerns of the company. Often, they disclosure such a report to legitimize their behaviour and actions. The government of Denmark reacted in 2009 and the one of France in 2012 to named protests with a law requiring companies meeting certain criteria to publish a report that contains non-financial information.

The importance of Greener Public Purchasing, GPP, has increasingly been recognised by those who work to promote sustainable development. In the communication on Integrated Product Policy, IPP, the EU Commission encourages Member States to draw up publicly available action plans to green their public procurement. The Nordic Council of Ministers has stressed the importance of GPP in the strategy for sustainable development and has initiated co-ordination efforts so that public buyers in all the Nordic countries can benefit from each other's experience. The aim of this study was to develop a method to measure the environmental soundness of public procurement and to produce information on the kind of environmental criteria that are used for different product groups. The study also focused on the situation of greener public procurement in Denmark, Finland, Norway and Sweden, more specifically, on the larger public purchases, which are governed by directives. The results showed that public purchasers seek to consider environmental aspects quite often. However, attention needs to be paid to how relevant product-specific environmental aspects are defined and the criteria formulated.

An amendment to the Danish Financial Statements Act and related provisions for institutional investors etc. have introduced mandatory Corporate Social Responsibility (CSR) reporting for large Danish private and state-owned companies, institutional investors, etc. The reporting requirement was preceded by a governmental Action Plan on CSR which, among other initiatives, announced plans to make CSR reporting mandatory. The reporting requirement does not define CSR but provides that CSR is understood as the voluntary integration in companies' policies and practices of human rights, social issues, environment, climate and anti-corruption, amongst others. The reporting provision established an option to report, for the purposes of the Danish Act, through submission of a Communication of Progress (CoP) Report under the United Nations Global Compact and/or the Principles for Responsible Investment (PRI). The reporting requirement seeks to promote CSR through transparency. It has a related objective of making more Danish companies participate in the Global Compact. Reporting itself is enforced through government monitoring and fines. Through drawing on civil society monitoring and social and economic sanctions, the reporting provision in a wider sense complements the rather limited international law regime in relation to adverse business social and environmental impact. Based on the role which the Danish Government's Action Plan and the reporting requirement assign to "internationally agreed principles" and to international human rights and labour rights law in particular, the article argues that initiatives such as the Danish reporting requirement may support a trend towards migration of international human rights law into other legal systems, including national company law, companies' self-regulation and their contracts with business partners.
