Growing interest in corporate social responsibility (CSR) has focused attention on the relationship between businesses and key stakeholders, such as NGOs and local communities. Curiously, however, commentators on CSR rarely discuss the role of trade unions, while commentators on employment relations seldom engage with CSR. This situation is all the more remarkable since unions are a critically important social actor and have traditionally played a prominent role in defending the interests of one key stakeholder in the company, the employee. Written by dedicated experts in their field, this book addresses a key gap in the literature on both CSR and employment relations, namely trade union policies towards CSR, as well as union engagement with particular CSR initiatives and the challenges they face in doing so. The research covers eleven European countries which, when taken together, constitute a representative sample of industrial relations structures across the continent. This book will be essential reading for scholars, students and practitioners of international business, employment relations, public policy and CSR. Its foreword is written by Philippe Pochet and Maria Jepsen, Directors of the European Trade Union Institute in Brussels.

Trade unions in Europe have showed a mixed response to Corporate Social Responsibility (CSR) and have adopted a broad spectrum of positions on CSR. Prior research has identified five distinct positions of trade unions across Europe. The key argument is that the whole process is linked to neoliberalism and the outcome of neoliberal approach is deregulation. Withdrawal of state from regulation of businesses has created a vacuum of regulation and there are inadequate governance mechanisms available at all levels. Businesses have tried to fill this vacuum by engaging in CSR. Trade unions are apprehensive of CSR due to its voluntary nature and some see CSR as a threat because there is evidence that adoption of CSR as an alternative to binding regulations has hampered trade union power. Trade unions are trying to develop some supranational regulatory institutions and development of IFAs is an evidence of that. Trade unions are advised to broaden their agenda by adding non-traditional items such as climate change that might possibly provide further legitimacy to trade unions.

Since 1945, socially moderated market economies have formed the cornerstone of the European socioeconomic model. Now, however due to powerful global economic, political and demographic tendencies tensions between social and economic interests and values are increasing. These developments create an urgent need for answers, actions and measures on the European level. This wide-ranging but focused collection of essays approaches this important trend from multiple perspectives. Compiled in honour of the major European labour law scholar Teun Jaspers, it encompasses a broad spectrum of analyses and insights by forty-one distinguished contributors from seven countries. Four major tensions are identified: between the European and national level, between fundamental rights and economic freedoms, between workers and employers, and between soft and hard law instruments. Throughout, a comparative approach is emphasized, not only within the EU but also between the EU and China and South Africa. Among the many topics covered are the following: relocation of labour to low-wage countries both within and outside the EU; conditions for tempering the excesses of the free labour market; the legal weight of voluntary standards such as codes of conduct; extending the scope of application of corporate social responsibility norms to transnational enterprises; pressure on national social law due to flexibilization, deregulation and individualization; contract termination protection; employability and training of employees; fixed-term work in the wake of the Mangold ruling; adjustment of working conditions for ill and disabled workers; right to strike; and restructuring of enterprises. In light of the Lisbon strategy, the authors address how the various tensions should be reconciled, especially in the context of the flexicurity approach. The book will be of great interest to academics and practitioners for its clear categorization of the issues which must be overcome when regulating employment and social policy in the context of todayand’s EU multilevel legal order. It pays detailed attention to the legal questions raised by emerging European labour and employment policies in respect of their specific materialization, the opportunities they offer, their feasibility, and the threats they pose to traditional workerand’s protection and, more generally, to traditional concepts of labour law.

Inhaltsangabe:Abstract: In recent years, more and more people expressed their concerns about some companies performance. Mainly not about their financial performance, but about their social performance. About their attitude towards the environment. About the treatment of employees. Consumers, governments, environmentalists, trade unions, but also managers felt that there is a need for change in business life. The concepts of Corporate Social Responsibility (CSR) and Corporate Citizenship are seen as the way where business needs to go in the future. The basic idea of the concepts is that companies are a vital part of the society and that they cannot ignore this any longer. Business has both the power and the responsibility to behave in a way that satisfies not only shareholders, but also employees, customers, the environment, the community, and the society as a whole. In this paper I will give an overview of the new approach to business responsibility. It is an incredibly huge topic, related to many important issues. It would have been possible to write hundreds of pages about subtopics like the employee-employer relationship or environmental issues. I chose a different approach and will give a panoramic view of this fascinating and complex topic. Of course, I had to focus on some of the most important issues, but I consider a holistic approach as very important, as it shows the interrelation between business and its stakeholders. After a general introduction to the topic in Chapter 1, I will define the different areas of Corporate Social Responsibility and give a short summary of the history of CSR. Following this, I will present the reasons why the topic of socially responsible companies becomes more and more important. Chapter 4 will focus on an introduction of the main issues of CSR, including Human Rights, environmental issues, corporate governance and many more. In the main part of this paper, Chapters 5 to 9, I will explore the issues of CSR which I consider most important. I will present the hottest topics and how business responds to them. This will not only be done theoretically, but I will also give examples of companies who tried to go new ways. Even though I think that the new approach called CSR is definitely a top business approach for the future, I tried to question the approach and to find critical points, which will be presented directly in the different chapters. The concept of Corporate Social Responsibility as a whole is [...]

Business in a globalised world is no longer only about profit. Companies that operate globally are increasingly being called to account over their social responsibilities to the workforce, local communities and the environment. Companies that take these responsibilities seriously are faced with a plethora of problems and dilemmas. For example, how can companies navigate the sea of tension between observing international rules of conduct and responding to specific local cultural circumstances? How can they ensure social responsibility in the product chain(s) in which they operate? And how can they best contribute to the local economy of developing countries? This book helps companies with good intentions but little experience to find answers to these questions and many others. The book offers concrete guidelines, step-by-step plans and practical examples based on the experiences of 20 diverse, large, medium and small companies that participated in the three-year Dutch programme "Corporate Social Responsibility in an International Context" organised by CSR Netherlands. Corporate Social Responsibility and Globalisation constitutes a guidebook and action plan to enable companies of all sizes to manage risk and seek out opportunities for engagement in their overseas operations.
