This article delves into the murky waters of homophobic victimisation within the post-Apartheid South African society. It draws attention specifically to a sub-group within the lesbian, gay, bisexual and transgender (LGBT) community by critically examining the phenomenon of corrective rape that has befallen them in the recent past years. The article seeks to achieve a critical examination of corrective rape in South Africa a threefold manner. Firstly, and as a point of departure, the article takes a look at some of the prominent cases of corrective rape that have not only captured the attention of the nation, but also that of the international community. It looks not only at the sensational stories published by media but also at the response of the criminal justice system to the cases that have surfaced before it. In so doing the article aims to establish that corrective rape is a reality for lesbian women in South Africa. Once the reality of corrective rape has been established, the article seeks to then answer the questions as to whether or not corrective rape can be and should be categorised as a hate crime offense. These two questions are addressed in a comparative manner, by examining the definition of hate crime and the definitional characteristics of the latter. These are then applied to corrective rape within the South African context in an attempt to establish whether or not the latter is truly a hate crime and should be seen and dealt with as such by the South African legal system. In this part of the examination, the by-question of whether or not the South African legal framework should recognise hate crime offenses as a separate category crime filters through. However, the latter question is only addressed as the article progresses. From the theoretical, the article returns to the current reality to not only comprehensively discuss the national and international legal measures that have been put in place to protect lesbian women from homophobic victimisation but also to discuss the reasons why these legal measures are allegedly failing South African lesbian women this regardless of the heart and soul that has been poured into the South African constitutional jurisprudence. The aim of this part of the examination is to establish what, if anything at all, can still be done to offer better protection to lesbian women all across the nation, regardless of their social class. Having completed all three of the above and in the penultimate, the article makes recommendations that touch on both the law and human rights education policies of the nation. The main focus of the author's submissions is on reform as well as education and awareness. These recommendations are made in the hopes that in the nation's endeavor to provide better protection for the most vulnerable in our society these will be progressive steps. The article then concludes with final thoughts as to what has been learnt and established in each substantive chapter. Copyright.

"Corrective rape," an act characterized as a man raping a lesbian in an effort to turn her straight, is a growing problem in South Africa. Despite being hailed as the rainbow nation, South Africa has neglected to address incidents of discrimination and hate crimes perpetrated against lesbians. In this thesis, I use an intersectional frame to examine accounts of "corrective rape" in 95 articles published between 2009 and 2013 in 13 different South African newspapers. I begin by tracing the production and construction of "corrective rape," in particular how the media discourse constructs the attacks and how it marginalizes the women who survive these attacks. Then, drawing from poststructural discourse analysis, I demonstrate how South African-ness is constituted around discourses of lesbianism and "corrective rape," in particular how the media discourse constructs how views on lesbians and "corrective rape" are either antithetical to being truly South African or are key in establishing oneself a part of democratic South African culture. Finally, I offer some thoughts on the implications these findings have for the global discourse on lesbians.

In this investigation of sexual violence against LGBTI individuals in South Africa, esteemed journalist Charlayne Hunter-Gault sheds light on practices of "corrective rape" — an assault in which a man rapes a lesbian in an attempt to “cure” her sexual orientation. This book examines the wider social context of anti-LGBTI sentiment in South Africa, a country that was the first in the world to include constitutional language forbidding discrimination on the ground of sexual orientation, and the search for equality in a post-apartheid nation. Hunter-Gault interviews sexual assault victims and explores South Africa's problem of sexual violence — particularly against black lesbians — within the lens of the country's complicated history towards human rights. Based on a 2012 article the author originally published in the New Yorker, this book features an extensive amount of new material with updated historical perspective, interviews, and case studies. Corrective Rape is a critically important and eye-opening account of a devastating problem within one of Africa's most populous and economically advanced nations. Anyone concerned with the rights of individuals in the gay and lesbian community, as well as human rights in general around the world, needs to be informed on this topic. Hunter-Gault, an award-winning journalist with years of experience reporting on civil rights and injustice around the globe, has crafted an engaging, fast-paced read that will spur dialogue and inspire action.

"Social prejudice against lesbians, gay men, and transgender people is prevalent in South Africa even as the country has progressive laws prohibiting discrimination on the grounds of sexual orientation. Lesbians, bisexual women, transgender men, and other gender non-conforming people in South Africa are subject to widespread discrimination, harassment, and violence. They are regularly thrown out of home; ridiculed and abused at school; harassed and insulted on the streets, in church, and at work; and threatened by neighbors and strangers. The abuse may be verbal, physical, or sexual--and may even result in murder. "We'll Show You You're a Woman" documents the violence and abuse faced by working-class South African black lesbians, transgender men, and gender non-conforming people, detailing the everyday climate of fear and impunity within which they must attempt to negotiate their safety. It identifies specific factors that enhance their vulnerability but also places the violence against them in broader context, including the country's alarming rates of gender-based violence. South Africa already has in place many laws and policies to address sexual violence and discrimination; what is sorely lacking is effective implementation of those provisions. The report concludes with recommendations to specific ministries and departments of the South African government aimed at better safeguarding the rights and safety of lesbians and transgender men."--P. "The country we want to live in: Hate crimes and homophobia in the lives of black lesbian South Africans offers a refreshing perspective on violence perpetrated against black lesbians. Based on a Roundtable seminar, held during the 2006 16 Days of Activism for no Violence against Women and Children, the text engages the heteronormative focus of the campaign, profiles aspects of the dynamic conversations, and builds strong arguments about violence against lesbians. It also profiles the voices of women who are central to the activism around hate crimes and homophobia. In capturing key aspects of the lively discussion of 2006, an update of subsequent events that have bearing on the original seminar is provided, concluding with recommendations that have relevance for research, policy and practice. The country we want to live in makes an impassioned plea about citizenship, belonging and social justice, confirming that silence about these issues is not an option"--Cover.

Homosexuality is a cross-cutting challenge to Malawian society with theological, socio-cultural, economic, legal, political, and human rights implications. This book argues that the solution to the homosexuality debate in Malawi does not lie in either the criminalization or decriminalization of homosexuality; neither does it lie in homophobia nor heterophobia. However, the solution to the homosexuality debate lies in achieving a harmonious co-existence of both heterosexuals and homosexuals by practicing mutual tolerance. The book concludes by suggesting various activities to be taken by: The Government of Malawi; Gay Rights Activists; Religious Leaders; Traditional Leaders; and Malawian Society to ensure the aforementioned tolerance and understanding is encouraged.
