When people pay bribes to foreign public officials, how should the law respond? This question has been debated ever since the enactment of the U.S. Foreign Corrupt Practices Act of 1977, and some of the key arguments can be traced back to Cicero in the last years of the Roman Republic and Edmund Burke in late eighteenth-century England. In recent years, the U.S. and other members of the OECD have joined forces to make anti-bribery law one of the most prominent sources of liability for firms and individuals who operate across borders. The modern regime is premised on the idea that transnational bribery is a serious problem which invariably merits a vigorous legal response. The shape of that response can be summed up in the phrase "every little bit helps," which in practice means that: prohibitions on bribery should capture a broad range of conduct; enforcement should target as broad a range of actors as possible; sanctions should be as stiff as possible; and as many agencies as possible should be involved in the enforcement process. An important challenge to the OECD paradigm, labelled here the "anti-imperialist critique," accepts that transnational bribery is a serious problem but questions the conventional responses. This book uses a series of high-profile cases to illustrate key elements of transnational bribery law in action, and analyzes the law through the lenses of both the OECD paradigm and the anti-imperialist critique. It ultimately defends a distinctively inclusive and experimentalist approach to transnational bribery law.

Political corruption has traditionally been presented as a phenomenon characteristic of developing countries, authoritarian regimes, or societies in which the value system favored tacit patrimony and clientelism. Recently, however, the thesis of an inverse correlation between corruption and economic and political development (and therefore democratic "maturity") has been frequently and convincingly challenged. Countries with a long democratic tradition, such as the United States, Belgium, Britain, and Italy, have all experienced a combination of headline-grabbing scandals and smaller-scale cases of misappropriation. In "Corrupt Exchanges," primary research on Italian cases (judicial proceedings, in-depth interviews, parliamentary documents, and press databases), combined with a cross-national comparison based on a secondary analysis of corruption in democratic systems, is used to develop a model to analyze corruption as a network of illegal exchanges. The authors explore in great detail the structure of that network, by examining both the characteristics of the actors who directly engage in the corruption and the resources they exchange. These processes of degeneration have caused a crisis in the dominant paradigm in both academic and political considerations of corruption. The book is organized around the analysis of the resources that are exchanged and of the different actors who take part. Politicians in business, illegal brokers, Mafia members, protected entrepreneurs, and party-appointed bureaucrats exchange resources on the illegal market, altering the institutional system of interactions between the state and the market. In this complex web of exchanges, bonds of trust are established that allow the corrupt exchange to thrive. The book will serve both as a theoretical approach to a political problem of large bearing on democratic institutions and a descriptive warning of a system in peril.

A social theory of grand corruption from antiquity to the twenty-first century. In contemporary policy discourse, the notion of corruption is highly constricted, understood just as the pursuit of private gain while fulfilling a public duty. Its paradigmatic manifestations are bribery and extortion, placing the onus on individuals, typically bureaucrats. Sudhir Chella Rajan argues that this understanding ignores the true depths of corruption, which is properly seen as a foundation of social structures. Not just bribes but also caste, gender relations, and the reproduction of class are forms of corruption. Using South Asia as a case study, Rajan argues that syndromes of corruption can be identified by paying attention to social orders and the elites they support. From the breakup of the Harappan civilization in the second millennium BCE to the anticolonial movement in the late nineteenth and early twentieth centuries, elites and their descendants made off with substantial material and symbolic gains for hundreds of years before their schemes unraveled. Rajan makes clear that this grander form of corruption is not limited to India or the annals of global history. Societal corruption is endemic, as tax cheats and complicit bankers squirrel away public money in offshore accounts, corporate titans buy political influence, and the rich ensure that their children live lavishly no matter how little they contribute. These elites use their privileged access to power to fix the rules of the game—legal structures and social norms—benefiting themselves, even while most ordinary people remain faithful to the rubrics of everyday life.

Over the past decade, countries have increasingly used settlements that is, any procedure short of a full trial to conclude foreign bribery cases and have imposed billions in monetary sanctions. There exists a gap in knowledge, however, regarding settlement practices around the world and the disposition of these monetary sanctions notably through the lens of recovery of stolen assets. Left out of the Bargain, a study by the Stolen Asset Recovery Initiative (StAR), provides an overview of settlement practices by civil and common law countries that have been active in the fight against foreign bribery. Using the United Nations Convention against Corruption (UNCAC) as its point of reference, the study addresses concerns voiced by the international community: What happens to the money associated with the settlements, and is it being returned to those most directly harmed by the corrupt practices? And what can be done to assist those countries harmed by foreign bribery? Left out of the Bargain has found that 395 settlement cases took place between 1999 and mid-2012, resulting in a total of US$6.9 billion in monetary sanctions imposed against companies and individuals. Of this amount, nearly US$6 billion came from settlements that took place in a country different from that of the allegedly bribed foreign public officials. But only about US$197 million, or 3 percent, has been returned or ordered returned to the countries whose officials were accused of accepting bribes. Left out of the Bargain urges countries whose officials were allegedly bribed to intensify their efforts to investigate and prosecute the providers and recipients of foreign bribes, hence improving these countries' prospects for recovery of assets lost through corruption. The study also calls for more proactive international cooperation and coordination to ensure that all affected countries are afforded the opportunity to seek redress for harms suffered and for the recovery of assets thus fulfilling the principles set out in UNCAC.

Many studies show that corruption is not only a bargaining problem between an agent that has an specific objective and an official that demand a bribe to do her job. Other lines of research analyzes how social structures are the origin of a corrupt society. In this work I combine the individualistic approach of economictheory with the social view of other social sciences such as sociology, political sciences and business administration to study corruption and the role of monitoringagencies when corruption takes place in a network structure. I will try to provethat if the social network is complete (i.e. it exhibits no gaps) then the coordinationamong agents is more fluent and it is easier to achieve corrupt objectives. On the other hand, institutions can generate incentives even if the network is complete. When monitoring agencies are included, it is important for institutions and monitoringagencies to complement each other to prevent more effectively the act of corruption. For this, I combine two theories on human behavior: social network theory and game theory. After studying four possible settings, two without monitoring agencies and two including them, I find that the hypothesis cannot be ruled out. Moreover, if the penalty for corrupt behavior is low (or the administrative cost of justice is high) then agents will prefer to get involved in corrupt activities, specially if the network is complete. On the other hand, if honesty is highly rewarded, agents have enough incentives to reject corrupt proposals. The existence of monitoring agencies represented as free press can discourage corruption fromthe beginning.
