This book argues that the effective protection of fundamental rights in a contemporary, multicultural society requires not only tolerance and respect for others, but also an ethics of reciprocity and a pursuit of dialogue between different cultures of human rights. Nowadays, all cultures tend to claim an equitable arrangement that can be articulated in the terms of fundamental rights and in the multicultural organization of the State. Starting from the premise that every culture is and always was intercultural, this book elaborates a new, and more fundamentally, pluralist view of the relationship between rights and cultural identity. No culture is pure; from the perspective of an irreducible cultural contamination, this book argues, it is possible to formulate constitutional idea of diversity that is properly intercultural. This concept of intercultural constitutionalism is not, then, based on abstract principles, but nor is it bound to any particular cultural norm. Rather, intercultural constitutionalism allows the interpretation of rights, rules and legal principles, which are established in different contexts.

Nel volume si conduce, da una prospettiva di diritto costituzionale, un’analisi critico-teorica delle più rilevanti elaborazioni dottrinarie ascrivibili al c.d. costituzionalismo globale, in particolare in una duplice direzione. Da un lato, viene in rilievo una dimensione pienamente globale e “orizzontale”, laddove il costituzionalismo globale risulta inquadrabile come un fenomeno di diffusione mondiale e crescente convergenza del diritto costituzionale e delle costituzioni statali, mentre, dall’altro lato, esso si configura come un processo di “costituzionalizzazione” del diritto internazionale, ossia di progressiva applicazione a quest’ultimo delle categorie dottrinarie e degli schemi teorici, e in parte operativi, propri del diritto costituzionale. Il volume, pertanto, anche sulla scorta di tale analisi teorico-dottrinaria, intende saggiare la praticabilità del costituzionalismo globale, cercando segnatamente di rispondere all’interrogativo se ci si debba rassegnare ad un ordine globale anarchico e incontrollato che potrebbe mettere in pericolo la tenuta di istanze costituzionali e democratiche, ovvero se il costituzionalismo sia ancora in grado di svolgere, anche nell’epoca globale, la sua “missione” storica, vale a dire quella di “catturare” il potere e garantire la tutela dei diritti fondamentali.
