Negli ultimi trent'anni la criminalità in Italia è crollata: gli omicidi, che nel 1991 furono 1.938, sono oggi poco più di 300 e anche gli altri reati sono in larga parte diminuiti. La popolazione carceraria è tuttavia quasi raddoppiata e il numero degli ergastoli è più che quadruplicato, passando dai 408 del 1992 agli attuali 1.867. È cambiata radicalmente anche la politica penale. Ancora negli anni Novanta la maggioranza dei parlamentari italiani era favorevole all'abolizione dell'ergastolo, votata dal Senato il 30 aprile 1998 da una larghissima maggioranza. Oggi tutte le forze presenti in Parlamento respingono, come un'accusa infamante, l'idea di essere a favore dell'abolizione non diciamo dell'ergastolo, ma perfino del carcere duro dell'ergastolo ostativo. Questi straordinari mutamenti non sono spiegabili se non come effetti della riduzione delle garanzie del corretto processo quali limiti all'arbitrio punitivo e del declino della cultura garantista sia nel ceto politico che nel ceto giudiziario. Contro tale regressione, questo libro ripropone il modello classico della giurisdizione penale come accertamento dei reati legalmente predisposti, su cui si fonda la sua legittimazione democratica. Propone il rafforzamento delle garanzie penali e processuali idonee a realizzare tale modello. Sostiene infine la necessità di sviluppare una teoria del garantismo penale entro una teoria generale del garantismo, sulla base delle tesi che la maggior parte dei reati si previene con garanzie dei diritti e con politiche sociali, ben più che con politiche penali, e che il garantismo penale designa l'ultima e la più infelice delle tecniche di garanzia della sicurezza pubblica dai delitti e dalle pene arbitrarie.
