Il volume raccoglie alcuni saggi scritti dall’autore negli ultimi dieci anni, che si affiancano a contributi più organici e ne puntualizzano temi e problemi: Diritto Pubblico della “proprietà” e dei “beni” (Torino, 2022), Prima lezione di diritto amministrativo (Bari, 2021), Lineamenti di diritto amministrativo (7° ed., Torino, 2021); Amministrazione Pubblica e diritto privato (Torino, 2011). I saggi, come anche questi volumi, ruotano intorno a due nodi problematici della disciplina. Il rapporto dell’amministrazione (come funzione di governo e come apparato deputato all’esercizio della funzione) con le altre funzioni di governo, sulla base dell’assetto costituzionale, secondo principi che investono l’amministrazione (c.d. costituzionalizzazione dell’amministrazione) in modo assai più incisivo rispetto al passato; e allo stesso modo investono la giurisdizione, che estende il suo “controllo” su ogni manifestazione dell’amministrazione, anche al fine di assicurare la piena tutela delle situazioni soggettive protette. Il rapporto tra diritto pubblico e diritto privato (diritto comune) nell’azione amministrativa (contratti, moduli consensuali, atti aziendali, etc.) e nell’organizzazione dei pubblici uffici (società pubbliche, aziende). I principi costituzionali (imparzialità, buon andamento, tutela dei diritti e degli interessi legittimi) si estendono ai rapporti di diritto privato delle pubbliche Amministrazioni e alle organizzazioni pubbliche in forma privatistica. Ciò comporta deroghe, spesso di non facile definizione, rispetto alla disciplina di diritto comune.
