La Costituzione ragionata è uno strumento per accedere al testo costituzionale specie per coloro che studiano per la preparazione degli esami universitari (di diritto costituzionale, di istituzioni di diritto pubblico e di diritto regionale) e dei concorsi pubblici. L'idea da cui si è partiti è semplice ma non trascurabile: se allo studio sistematico (da svolgersi con l'ausilio di un manuale, si consigliano a seconda delle esigenze il Manuale di Diritto costituzionale di F. Lisena o il Manuale di Istituzioni di diritto pubblico di L. Saltari, C. Cataldi e C. Di Seri, Neldiritto, ult. ed.), si affianca la lettura e la comprensione delle disposizioni costituzionali e dei suoi "frammenti costitutivi", diviene più facile la ricostruzione e l'apprendimento dei principi e istituti, come elaborati dalla Corte costituzionale e dalla scienza del diritto pubblico. Seguendo questo approccio nei "ragionamenti" relativi ad ogni articolo della Costituzione sono riprese ed esaminate le principali questioni poste dalle singole parti di ciascuna disposizione. La struttura del volume è, quindi, concepita per essere un comodo sentiero d'accesso alla Carta costituzionale. Pertanto, ogni articolo della Costituzione è corredato da un commento che si articola in due parti: nella prima, vi è un'esplicazione nella quale sono evidenziati la ratio e il contenuto della disposizione, nonché il contesto in cui la stessa si colloca; nella seconda, sono individuate e spiegate analiticamente le parole-chiave, evidenziate nel corpo della disposizione costituzionale in grassetto quando direttamente riferite ad essa. Sovente nella sezione parole-chiave vi sono dei rinvii interni che consentono di collegare più disposizioni e far così emergere le connessioni interne all’ordito costituzionale. Per questi motivi, ci sembra che l’Opera costituisca un indispensabile completamento dei tradizionali Manuali: mentre questi ultimi muovono dall'astrattezza dei principi ed illustrano come questi si “inverano” nelle singole disposizioni, la Costituzione ragionata parte dalle norme e, segnatamente, dalle nozioni che fungono da “mattoni” fondamentali dell'edificio costituzionale la cui comprensione e memorizzazione è indispensabile per formare una preparazione adeguata, necessaria per giungere a padroneggiare il sistema. La lettura congiunta del Manuale e della Costituzione ragionata permette a chi studia di sommare queste due diverse ma complementari prospettive, ricavando una visuale completa e aggiornata della materia.

Are foreign investors the privileged citizens of a new constitutional order that guarantees rates of return on investment interests? Schneiderman explores the linkages between a new investment rules regime and state constitutions – between a constitution-like regime for the protection of foreign investment and the constitutional projects of national states. The investment rules regime, as in classical accounts of constitutionalism, considers democratically authorized state action as inherently suspect. Despite the myriad purposes served by constitutionalism, the investment rules regime aims solely to enforce limits, both inside and outside of national constitutional systems, beyond which citizen-driven politics will be disabled. Drawing on contemporary and historical case studies, the author argues that any transnational regime should encourage innovation, experimentation, and the capacity to imagine alternative futures for managing the relationship between politics and markets. These objectives have been best accomplished via democratic institutions operating at national, sub-national, and local levels.
