El enfoque represivo, en este caso la política punitiva tradicional, ha demostrado ser insuficiente para combatir la corrupción; de ahí que las investigaciones aquí contenidas concuerden en que es necesario fortalecer mecanismos alternativos como el control interno, poner énfasis en la implementación de medidas preventivas y fomentar la tecnificación y las buenas prácticas en el ejercicio de funciones estatales.

Desde el año 2012 el Centro Externadista de Estudios Fiscales ha venido presentando a la comunidad académica diversos textos analíticos con el propósito de divulgar el alcance de las modificaciones al sistema tributa-rio. así como los problemas que se vislumbran en su aplicación y sus eventuales soluciones. En ese sentido, la presente obra colectiva plantea en diez capítulos los principales elementos de la reforma tributaria de la Ley 2155 de 2021, Ley de Inversión Social. que resultó ser un sucedáneo temporal y pragmático ante la fallida propuesta de reforma tributaria del año 2021. El libro aborda las reformas a los impuestos sobre la renta, destacando las dudas que aún existen sobre la determinación oficial de implementar la factura electrónica; los cambios al IVA, particularmente la regulación del día sin IVA; los ajustes al régimen SIMPLE; los mecanismos de recaudo ya comunes en todas las reformas; las reglas que afectan el procedimiento tributario y el mecanismo de obras por impuestos; el beneficiario efectivo y su registro; la reforma territorial y la necesidad de afrontarla sin demora. y los contextos tanto fiscal como económico de la reforma. En esta publicación los investigadores y docentes del Departamento de Derecho Fiscal presentan al público el resultado de sus observaciones con el fin de dejar un registro histórico que permita comprobar el alcance de las modificaciones, y las inquietudes académicas y prácticas relacionadas con la reforma tributaria de la Ley de Inversión Social.
