Many scholars think that fashion is closer to the brink of disaster: too fast, too polluting, poorly focused on creativity and on the market, too cheap for the consumer and little profitable for small- and medium-sized companies, too unpredictable and subjective to be treated like the other industry sectors, too tangible to be regarded as a cultural product and too intangible to be considered a manufacturing product. Then, is fashion going to collapse? This book suggests another perspective and explains the economic theory of hybrid creative products, focusing on the reasons underlying that sense of an "abyss at the end of the tunnel." It rejects alarmism and tries to explain the structural changes taking place within the industry as well as the current meaning of fashion for the consumers and the market. These changes are directly associated with three crucial elements for the fashion business: time, risk, and costs. Therefore, creativity is still important, but is no longer sufficient. Commercial success largely depends on the business model of the company, i.e. on its ability to react to these changes. Fast fashion, sustainable fashion, the "see now - buy now" runaway shows, the deplorable use of child or underpaid labour can be explained in the light of this new scenario. Few economists have tried to find a new interpretation, but the theory of hybrid creative products can help us understand what happened in the past and what will happen in the future.

Exploring the debate over the benefits of legal protection for fashion design, this book focuses on how a combination of minimal legal protections for design, evolving social norms, digital technology, and market forces can promote innovation and creativity in a business known for its fast-paced remixing and borrowing. Focusing on the advantages and disadvantages of the main US and EU IP laws that protect fashion design in the world’s biggest fashion markets, it describes how recent US case law in copyright and trademark cases has led to misaligned incentives for the industry and a lack of clear protection, while, in the EU, the CJEU’s interpretation of the pan-European design rights system has created significant overlap with copyright law and risks, leading to the overprotection of design. The book proposes that creativity and innovation in fashion derive some benefit from a limited unregistered design right protection, and that cumulation with copyright protection is unhelpful. It also proposes that there is a larger role for developing social norms relating to sustainability, the ethics of cultural appropriation, and the online shaming of counterfeiters that can also help create a fair equilibrium between protection and borrowing in fashion design.

In this paper an ideal type of creative process inside Fashion Industry is analyzed: the “travail en atelier”, a way of organizing the design of new fashion goods. The “travail en atelier” structures the collection process into a collective work, using an “intensive technology”, it “craft administrates” and regulates the work via the authority of the fashion designer (representing the unity of direction of the process), via deadlines and via intermediary objects. Significant relationships of the process pass through intermediary objects connecting different professionals as designers, pattern makers, etc. The data are taken from semi--structured interviews collected through a “Strategic Analysis” sociological inquiry and participant observation in French and Italian Fashion Houses. The “travail en atelier” is a concept apt to describe in organizational terms a way of working already sketched in the sociological literature about fashion, when talking about “diffuse creativity” as a main quality of the collection process. The concept allows to relate these peculiar qualities of the design process in fashion industry to some general problems of management of the innovation inside the organizations and to outline some guidelines for further comparisons with other creative industries as industrial design and architecture. Several hypothesis are advanced about the origin of this way of working : French haute couture is the natural candidate for it, but new developments in the study of fashion system have shown that Italian fashion system may have played a role in structuring the “travail en atelier”
