Power in the Village explores the formation of late-nineteenth-century Italian rural society in southern Brazil, through an examination of how Italian peasants in northern Italy and southern Brazil solved issues related to family honor. Looking specifically at social networks and justice practices to examine the kind of rationality that ruled individual and family behaviors, the book offers an understanding of the restoration of social balance in these communities, and explores the culture of immigrants, particularly in issues related to honor and morality. Taking as a case study the ambush and murder of a parish priest, Antonio Sorio, in January 1900 in Silveira Martins, a small town of Italian immigrants, Vendrame offers a reinterpretation of the society of Italian immigrants in southern Brazil. She argues that rather than being an idyllic picture of a homogeneous and harmonious society, the colonial settlements were places pervaded by tension, solidarity and self-interest, which guided individual and collective behavior. Aborda a colisão de direitos fundamentais entre o interesse social por uma persecução penal eficiente para obtenção de provas incidentes sobre o corpo humano de forma invasiva ou não invasiva, e o interesse particular em ver assegurados seus direitos e garantias individuais, como o direito à não autoincriminação. Para o STF, o nemo tenetur se detegere abarca o direito ao silêncio e o de não produzir nem permitir que se produzam provas autoincriminatórias, embora nos últimos anos haja uma tendência de restrição de seu âmbito de proteção, estando pendentes de julgamento alguns casos voltados à temática. Na linha de restrição ao direito à não autoincriminação, Alemanha e Espanha, dentre outros, admitem intervenções corporais invasivas e em sua grande maioria, ainda que dissentidas, com base no princípio da proporcionalidade. A partir da dupla dimensão dos direitos fundamentais em jogo, de um lado o direito à prova e do outro o direito à não autoincriminação, buscou-se a verificação de possíveis restrições ao último no plano principiológico, com fulcro na Teoria da Ponderação e no princípio da proporcionalidade. A doutrina pátria, com forte inspiração no direito comparado, vem traçando requisitos para admissibilidade das intervenções corporais e ao submeter a Lei 12.654/2012 e normas regulamentares a eles, demonstrou-se que não os cumpre integralmente, não passando pela chancela do princípio da proporcionalidade, posicionando-se pela inconstitucionalidade da lei.

A presente tese defende a autonomia da categoria da punibilidade no sistema de análise do crime. Ou seja, para existir responsabilidade criminal o facto deve ser típico, ilícito, culposo e também punível. Para identificar esses critérios, a tese parte de uma investigação histórica que lhe permite distinguir claramente os critérios de imputação (do facto) dos juízos de adequação da pena (Capítulos I a IV), culminando numa nova leitura da evolução da teoria do crime entre nós e numa reformulação metodológica do sistema do facto punível (Capítulos IV e VII). We hold many assumptions about police workÑthat it is the responsibility of the state, or that police officers are given the right to kill in the name of public safety or self-defense. But in The Killing Consensus, Graham Denyer Willis shows how in S‹o Paulo, Brazil, killing and the arbitration of ÒnormalÓ killing in the name of social order are actually conducted by two groupsÑthe police and organized crimeÑboth operating according to parallel logics of murder. Based on three years of ethnographic fieldwork, Willis's book traces how homicide detectives categorize two types of killing: the first resulting from ÒresistanceÓ to police arrest (which is often broadly defined) and the second at the hands of a crime "family' known as the Primeiro Comando da Capital (PCC). Death at the hands of police happens regularly, while the PCCÕs centralized control and strict moral code among criminals has also routinized killing, ironically making the city feel safer for most residents. In a fractured urban security environment, where killing mirrors patterns of inequitable urbanization and historical exclusion along class, gender, and racial lines, Denyer Willis's research finds that the cityÕs cyclical periods of peace and violence can best be understood through an unspoken but mutually observed consensus on the right to kill. This consensus hinges on common notions and street-level practices of who can die, where, how, and by whom, revealing an empirically distinct configuration of authority that Denyer Willis calls sovereignty by consensus.
