Akademische Arbeit aus dem Jahr 2004 im Fachbereich Psychologie - Forensische Psychologie und Strafvollzug, Note: 1,5 (CH:5,5), Universität Basel (Institut für Psychologie), Sprache: Deutsch, Abstract: Unter Criminal Profiling versteht man die Zusammenstellung von möglichen Persönlichkeitsmerkmalen, Verhaltensauffälligkeiten und Lebensumstände eines unbekannten Täters auf Grund genauer Analyse der Tatortspuren, sowie weiterer kriminalistischer und viktimiologischer Erhebungen (Meyer 2002). Nicht zuletzt die in jüngster Verhangenheit erfolgreich lancierten Kinofilme „Das Schweigen der Lämmer“, „Hannibal“ und TV-Serien wie beispielsweise „Profilier“ und „Das FBI ermittelt“ haben zu einem wahren Boom des Phänomens „Profiling“ beigetragen. Der ermittelnde „Profiler“ wird in den populärwissenschaftlichen Beiträgen sehr häufig als eine Art Wahrsager dargestellt, welcher scheinbar mittels hellseherischer Eingebung aus minimalen Tatortspuren eine nahezu perfekte Rekonstruktion des Geschehens inklusive einer detaillierten Täterbeschreibung erstellen kann. Doch was steckt hinter dem mystischen Schleier dieser hellseherisch anmutenden Ermittler? Welche konkreten Vorgehensweisen und Instrumente werden verwendet? Wie valid und reliabel sind die Methoden? Diese Arbeit liefert zunächst einen historischen Abriss über die Entwicklung dieser noch jungen Disziplin. Im weiteren Verlauf soll das Criminal Profiling definiert werden und ein Überblick über Ziele, Anwendungsgebiete, theoretische Prämissen und Aspekte wie das Tatortverhalten oder die Täterhandschrift gegeben werden.

Profiler rekonstruieren Tatabläufe der Fälle, bewerten das Verhalten des Täters und erstellen in den meisten Fällen ein Täterprofil. Wichtig dafür sind Persönlichkeitsmerkmale, Verhaltensauffälligkeiten und Lebensumstände eines unbekannten Täters. Sie fließen alle in die Analyse des Täterprofils ein. Profiler werden in Ausnahmesituationen gerufen, wenn die Polizei vor schwierigen Entscheidungen steht und Unterstützung benötigt. Durch das kriminalistische Hintergrundwissen vergleichen Sie den Fall mit anderen ähnlichen Verbrechen, die bearbeitet wurden und erstellen Fallanalysen oder auch Täterprofile. Diese werden in Deutschland ausschließlich von speziell ausgebildeten Beamten der Einheiten für operative Fallanalyse erstellt. Der Begriff „Profiling“ stammt aus den USA und wird dort als Täterprofilerstellung bezeichnet. Der generelle Grundgedanke, liegt in der Annahme, dass durch aufgefundene Tatortspuren, die Vorgehensweise, die Wahl des Opfers, das sexuelle, psychische und verbale Verhalten die Persönlichkeitsmerkmale des Täters reflektieren.

Das rekonstruierte Tatverhalten eines Gewaltverbrechers liefert einem „Criminal-Profiler“ angeblich sämtliche Informationen um detaillierte Aussagen über Geschlecht, Alter, Lebensraum, Intelligenz, Charakter, Persönlichkeitsstruktur, usw. generieren zu können. Criminal Profiling entwickelte sich zu einer Disziplin, welche zahlreiche akademische und wissenschaftliche Bereiche impliziert. Im Verlauf der Entwicklung dieser Disziplin kristallisierten sich zwei verschiedene Vorgehensweisen zur Profilerstellung heraus. Zum einen die induktive Profilerstellung, welche auf statistische und empirische Daten, sowie auf die individuellen Erfahrungswerte und Intuitionen des jeweiligen Profilers basiert. Zum anderen der deduktive Ansatz, nach dem jeder Fall als einzigartig angesehen wird. Die Profilerstellung erfolgt hier nach streng logischen Schlussfolgerungen und Syllogismen, basierend auf den vorgefundenen Tatortspuren und Beweisen. In dieser Arbeit werden beide Methoden vorgestellt. Es wird auch aufgezeigt, mit welchen psychologischen und methodischen Werkzeugen Profiler vorgehen, welche wissenschaftlichen Theorien dieser Tätigkeit zugrunde liegen und wo die Grenzen liegen.

The study propose to discuss the legal status of the concept of universal jurisdiction under international law and its conflict with other legal principles like State sovereignty, sovereign immunity and non-intervention. It will also highlight how jus cogens norms and obligatio erga omnes strengthen the concept of universal jurisdiction.
