Over the past 10-15 years, although the overall use of firearms in violent crime has declined, handguns have increasingly become the firearm of choice in both Australia and other English-speaking countries. Handguns are often used as a means of protection, particularly among people involved in gangs and the drugs market, and their concealable nature, high firepower and large calibre are often cited as features prompting their acquisition by the criminal community. This paper describes the use of handguns to commit lethal and non-lethal crime in Australia; and in light of recent legislative restrictions on handgun ownership and use, the legal status of handguns used in these crimes. Overall there appear to be low ownership rates among offenders in Australia. However, handguns currently account for around half of all firearm-related homicides and are distinguishable from other homicides, particularly with regard to location (non-residential), relationship between victim and offender (known but not related), and alleged motive (money or drugs). Handgun-perpetrated armed robberies are also found to be distinct from robberies committed with other weapons, with a higher proportion targeting organisations and netting greater monetary yields. The majority of handguns used in crime appear to be illegal. Available data suggest many are acquired from friends or family, and diversion, including theft from legal sources, may represent an important source of handguns (and other firearms) into the illegal market and their subsequent use in crime.

The term 'firearm offence' captures a broad spectrum of offending behaviour, from insecure storage of firearms to use in the commission of a violent crime, and hence a similarly broad spectrum of criminal conduct. The primary legislative framework for sentencing of firearm offences is based on enacted legislation in each jurisdiction that defines specific firearm-related offences, alongside minimum and maximum penalties. While offences largely relate to use, possession, ownership, registration, purchase, sale and storage of firearms, jurisdictional variation occurs in the range and classification of these offences, and the associated statutory penalty. Judicial discretion and the relative restriction of sentencing procedures operating in different jurisdictions can further act to influence a varying regime in the type and severity of sentences handed down. This research was undertaken in response to concerns about how effective firearm penalties are in preventing firearm-related offences. While not an evaluation of the effectiveness of penalties per se, the report examines data from New South Wales, Victoria, South Australia, Western Australia and the Australian Customs Service, to provide an overview of the type of firearm offences commonly brought before the courts, the outcomes from these proceedings, and the severity of sentences handed down.

However: firearm use has increased since the introduction of Taser weapons, and injuries to police officers have remained the same; Taser weapons are being used for compliance, including against indigenous people and those suffering mental illness, contrary to the intention of the WAPOL policy; Taser weapons are causing injury. There is a risk that Taser weapon use will lead to a death; and there is evidence in Western Australia that Taser weapons are being used in situations for which they were not intended to be used and where such use is potentially excessive or improper. This appears to be an increasing trend. The threshold for Taser weapon use and related policy environment needs to be changed to avert this trend.

'Recorded Crime - Victims, Australia', a publication from the Australian Bureau of Statistics, presents national crime statistics relating to victims of a selected range of offences that have been recorded by police. Between 2001 and 2002, the proportion of murders, attempted murders, kidnapping/abductions and robberies that involved a weapon decreased. In 2002, attempted murder was the offence most likely to involve either a firearm (22 per cent) or knife (35 per cent) whereas sexual assault was the offence least likely to involve a weapon. Between 2001 and 2002, the largest decreases in the type of weapon used in an offence were for firearms used in attempted murders, which dropped from 29 per cent to 22 per cent, and knives used in murders, which dropped from 29 per cent to 23 per cent.
