The global financial system has proven increasingly unstable and crisis-prone since the early 1980s. The system has failed to serve either creditors or debtors well. This has been reinforced by the global financial crisis of 2008, where we have seen systemic weaknesses bring rich countries to the brink of bankruptcy and visit appalling suffering on the poorest citizens of poor countries. Yet the regulatory responses to this crisis have involved little thinking from outside the box in which the crisis was delivered to the world. After the economic crisis of 2008, private-sector spending took nearly a decade to recover. Yair Listokin thinks we can respond more quickly to the next meltdown by reviving and refashioning a policy approach whose proven success is too rarely acknowledged. Harking back to New Deal regulatory agencies, Listokin proposes that we take seriously law’s ability to function as a macroeconomic tool, capable of stimulating demand when needed and relieving demand when it threatens to overheat economies. In een tijd van recessie treedt het belang van een goed functionerende rechtspraak voor de economie scherper aan het licht. Gegeven dit belang worden de mogelijkheden bezien van versterking van de infrastructuur van de rechtspraak ten behoeve van economische ontwikkeling. Een daarvan is de vergroting van de aantrekkelijkheid om complexe internationale juridische geschillen tussen bedrijven voor te leggen aan de Nederlandse rechter. In het bijzonder kan hierbij worden gedacht aan geschillen op het gebied van het internationale vervoer. Zorgelijk zijn de ontwikkelingen in politiek en samenleving die worden aangeduid als ‘een crisis in de rechtsstaat’ in hun mogelijke uitwerking voor de rechtspraak. Waar de staatsrechtelijke verhoudingen vooral worden bepaald door historisch gegroeide ongeschreven regels, dreigt bij afnemend respect voor deze regels bij de politieke machten aantasting van de onafhankelijke positie van de rechterlijke macht. De Grondwet biedt op dit punt onvoldoende waarborgen. Alertheid is hier geboden. De rechtspraak zal haar positie moeten versterken door een brug te slaan naar de samenleving. Rechters moeten daarvoor meer mogelijkheden krijgen om inzicht te krijgen in de maatschappelijke gevolgen van hun beslissingen. Een dergelijke jurisprudence of consequences kan helpen om de kloof met de burger te verkleinen en het maatschappelijk vertrouwen in de rechtspraak te vergroten. De wetenschap zal hieraan een belangrijke bijdrage kunnen leveren. De samenwerking tussen de rechtspraak en universiteiten moet worden geïntensiveerd.
