A falta de planejamento prévio na distribuição dos cartórios extrajudiciais nos municípios brasileiros é uma realidade que demanda mudanças urgentes para viabilizar a melhor prestação dos serviços notariais e registrais. As serventias extrajudiciais, denominadas cartórios ou ofícios, estão espalhadas por diversas regiões brasileiras e são criadas sem planejamento estratégico ou estudo de viabilidade para sua instalação. Essa prática que ocorre até os dias atuais prejudica o desenvolvimento da atividade notarial e registral, pois exige a união de esforços nas principais esferas ? como legislativa e executiva ? para que seja possível avançar na mudança visando à melhoria na qualidade da prestação desse serviço público. O presente trabalho busca realizar uma análise de indicadores à luz da administração pública em relação ao tema da reestruturação das serventias extrajudiciais tratada na Orientação n. 7, de novembro de 2018, do Conselho Nacional de Justiça (CNJ). Busca-se apresentar a importância das ferramentas do planejamento estratégico para a distribuição das serventias extrajudiciais. Inicia-se com um breve estudo da atividade notarial e registral e a delimitação do problema. Em seguida, parte-se para o diagnóstico do cenário atual e a definição dos objetivos a serem atingidos, buscando-se apresentar ao final, técnicas de planejamento e métodos da administração para a reestruturação das serventias extrajudiciais.

This is a penetrating reinterpretation and defense of Hegel's social theory as an alternative to reigning liberal notions of social justice. The eminent German philosopher Axel Honneth rereads Hegel's Philosophy of Right to show how it diagnoses the pathologies of the overcommitment to individual freedom that Honneth says underlies the ideas of Rawls and Habermas alike. Honneth argues that Hegel's theory contains an account of the psychological damage caused by placing too much emphasis on personal and moral freedom. Although these freedoms are crucial to the achievement of justice, they are insufficient and in themselves leave people vulnerable to loneliness, emptiness, and depression. Hegel argues that people must also find their freedom or "self-realization" through shared projects. Such projects involve the three institutions of ethical life--family, civil society, and the state--and provide the arena of a crucial third kind of freedom, which Honneth calls "communicative" freedom. A society is just only if it gives all of its members sufficient and equal opportunity to realize communicative freedom as well as personal and moral freedom.

Around the world, indigenous peoples use international law to make claims for heritage, territory, and economic development. Karen Engle traces the history of these claims, considering the prevalence of particular legal frameworks and their costs and benefits for indigenous groups. Her vivid account highlights the dilemmas that accompany each legal strategy, as well as the persistent elusiveness of economic development for indigenous peoples. Focusing primarily on the Americas, Engle describes how cultural rights emerged over self-determination as the dominant framework for indigenous advocacy in the late twentieth century, bringing unfortunate, if unintended, consequences. Conceiving indigenous rights as cultural rights, Engle argues, has largely displaced or deferred many of the economic and political issues that initially motivated much indigenous advocacy. She contends that by asserting static, essentialized notions of indigenous culture, indigenous rights advocates have often made concessions that threaten to exclude many claimants, force others into norms of cultural cohesion, and limit indigenous economic, political, and territorial autonomy. Engle explores one use of the right to culture outside the context of indigenous rights, through a discussion of a 1993 Colombian law granting collective land title to certain Afro-descendant communities. Following the aspirations for and disappointments in this law, Engle cautions advocates for marginalized communities against learning the wrong lessons from the recent struggles of indigenous peoples at the international level.
