Las Tecnologías de la Información y Comunicación (TIC) constituyen un logro para el mundo entero en constante desarrollo, cuyas bondades y beneficios son ampliamente conocidos. Hoy en día existen cada vez menos interacciones económicas, políticas, sociales y culturales que no hagan uso de las TIC, lo cual implica serios desafíos para el marco jurídico de cualquier Estado, en cuanto a diseño normativo, emisión de legislación e interpretación judicial. Las TIC demandan marcos normativos novedosos, prospectivos y se caracterizan por el empleo de terminología técnica, retos importantes para todos los operadores jurídicos en las distintas y amplias ramas del Derecho, en donde la interpretación judicial constituye una herramienta de gran valor para orientar, aclarar y/o desentrañar la naturaleza y finalidad de las normas en beneficio de los sujetos de derecho (autoridades y gobernados), fortaleciendo así el Estado Democrático de Derecho. En este sentido, conocer los criterios emitidos por el Poder Judicial de la Federación relacionados con las TIC se hace más que necesario, dada la constante evolución del Derecho obligada por el desarrollo tecnológico, motivo por el cual se ha elaborado la presente publicación, con la intención de divulgar diversos criterios emitidos por los tribunales judiciales federales de México derivado de la actividad jurisdiccional en diversos tópicos relacionados con las TIC. Esta publicación se integra de los criterios emitidos en la Quinta Época del Semanario Judicial de la Federación que comprende del 01 de junio de 1917 al 30 de junio de 1957. La Quinta Época constituye el inicio de la “jurisprudencia aplicable”.
