Numerosos precedentes de organismos internacionales, tanto del Sistema Universal de Derechos Humanos como del Sistema Interamericano, indican que la privación de libertad de una persona puede constituir un obstáculo para el goce de sus derechos humanos. Dentro del colectivo de personas privadas de su libertad, existen ciertos grupos que son especialmente vulnerables, ya que, por sus condiciones particulares de género, nacionalidad, edad, discapacidad, entre otras, se encuentran más expuestos a sufrir violencia y discriminación. El objetivo de la presente publicación es realizar un análisis de las decisiones jurisdiccionales del Tribunal Superior de Justicia de Córdoba, que se relacionen con el ejercicio de derechos de los grupos considerados especialmente vulnerables en contextos de encierro y guarden relación con los estándares del Sistema Interamericano. Asimismo, se procura elaborar un marco teórico de utilidad a los fines de la construcción por parte del operador judicial de una justicia más inclusiva.

Este segundo tomo se propone como una continuación del tomo I de la obra Criterios del Tribunal Superior de Justicia de Córdoba sobre enfoques diferenciados en la etapa de la ejecución de la pena. Así, retoma el objetivo de exponer los diferentes tópicos que hacen a las vulnerabilidades específicas que, en muchas ocasiones, conforman lo que se conoce como interseccionalidad, en el caso de personas en situación de prisión. Con este propósito, a lo largo de cada uno de los capítulos, se analizan las decisiones jurisdiccionales del Tribunal Superior de Justicia de Córdoba, que versaron sobre estos temas, siguiendo la línea iniciada en el libro anterior, que se valió como guía del mapa trazado en las Reglas de Brasilia sobre acceso a la justicia de las personas en condición de vulnerabilidad. Al igual que aquel, este fue elaborado por integrantes de la Defensa Pública Penal del Poder Judicial de la Provincia de Córdoba; de allí que la impronta del análisis está orientada hacia la construcción de nuevas pautas doctrinarias, que se aspira se conviertan en prácticas judiciales integradoras de derechos y garantías que deben ser considerados como una unidad que emerge de la dignidad personal de quienes se encuentran privados de su libertad.

Although sexual violence directed at both females and males is a reality in many on-going conflicts throughout the world today, accountability for the perpetrators of such violence remains the exception rather than the rule. While awareness of the problem is growing, more effective approaches are urgently needed for the investigation and prosecution of conflict-related sexual violence crimes. Upon its establishment in 1993, the Office of the Prosecutor (OTP) of the International Criminal Tribunal for the Former Yugoslavia (ICTY) began the challenging task of prosecuting the perpetrators of conflict-related sexual violence crimes, alongside the many other atrocities committed during the conflicts in the former Yugoslavia. This book documents the experiences, achievements, challenges, and fundamental insights of the OTP in prosecuting conflict-related sexual violence crimes at the ICTY over the past two decades. It draws on an extensive dossier of OTP documentation, court filings, trial exhibits, testimony, ICTY judgements, and other materials, as well as interviews with current and former OTP staff members. The authors provide a unique analytical perspective on the obstacles faced in prioritizing, investigating, and prosecuting conflict-related sexual violence crimes.
