Las sentencias dictadas por el Tribunal de Justicia siempre han sido consideradas un referente de extraordinaria relevancia que han servido para ir configurando una interpretación armónica del Derecho europeo de marcas. En el momento actual, esta jurisprudencia adquiere aun mayor importancia, desde el momento en que estas sentencias no solamente sirven para resolver los conflictos planteados por los Tribunales nacionales con ocasión del planteamiento de las correspondientes cuestiones prejudiciales, sino porque también resuelven los recursos que se presentan frente a las decisiones adoptadas por la Oficina de Propiedad Intelectual de la Unión Europea (EUIPO). En la presente obra se recogen con una visión práctica, los casos que resuelve el Tribunal de Justicia en los dos aspectos antes referidos. Para identificar convenientemente la sentencia y el tema tratado, cada sentencia se rotula con un título general que sirve para perfilar la materia enjuiciada. Por otra parte, la exposición de cada sentencia contiene un resumen básico de la misma y una sinopsis de los hechos origen del caso y de los pronunciamientos que el Tribunal de Justicia realiza en su aplicación. En la totalidad de los casos se realiza un breve comentario para resaltar los aspectos más importantes de la sentencia o las implicaciones prácticas que la doctrina jurisprudencial afectada puede tener. La obra se completa con un índice analítico según la materia tratada y una selección bibliográfica de diversos libros y artículos recientemente publicados en relación con el Derecho de marcas. Jesús Gómez Montero es Licenciado en Derecho por la Universidad de Santiago de Compostela (1976). Amplió sus estudios de especialización en Propiedad Industrial en el Departamento de Derecho Mercantil e Instituto de Derecho Industrial de la mencionada Universidad. En 1980, ingresó por oposición en el cuerpo de Letrados del Registro de la Propiedad Industrial (en la actualidad, Oficina Española de Patentes y Marcas) donde desempeñó su actividad hasta 1994, en varios puestos de responsabilidad, especialmente en el Departamento de Estudios y Relaciones Internacionales. En 1995, se integró en la Firma ELZABURU donde ejerció la profesión de abogado hasta 2019. Paralelamente, entre 1981 y 2017, desempeñó una actividad docente como Profesor de Derecho de la Publicidad en la Facultad de Ciencias de la Información de la Universidad Complutense de Madrid. Está colegiado en el Ilustre Colegio de Abogados de Madrid (como abogado no ejerciente). Es miembro del Consejo Asesor de la Fundación Alberto Elzaburu. Autor y coautor de varios libros y artículos, en la actualidad ejerce su actividad académica mediante su colaboración con diversas revistas e instituciones relevantes en el sector de la propiedad industrial.
