At the end of the 1980s, the development community experienced a major change of direction when the structural adjustment programs formerly in vogue lost ground in favor of the “good governance” approach. In this new orthodoxy, the effective application of “efficient” laws based on Western legal models is seen as a prerequisite to economic development. One of the major questions raised by the use of legal transfers for development purposes concerns the extent of the required “fit” between the transferred models and local cultures. Cultural explanations for the “underdevelopment” of certain communities have not only persisted, but have even increased in popularity in the last fifteen to twenty years, making them impossible to discard without careful examination. This Article thus aims to present the new law and development movement and the various “culture-based” approaches with respect to transcultural legal transfers, with a view to underlining the limitations of existing research and opening new perspectives on the investigation of the relationship between law and culture in developing countries.

The book investigates and compares the role of artistic and academic refugees from National Socialism acting as "cultural mediators" or "agents of knowledge" between their origin and host societies. By doing so, it locates itself at the intersection of the recently emerging field of the history of knowledge, transnational history, migration, exile, as well as cultural transfer studies. The case studies provided in this volume are of global scope, focusing on routes of escape and migration to Iceland, Italy, the Near East, Portugal and Shanghai, and South-, Central-, and North America. The chapters examine the hybrid ways refugees envisaged, managed, organized, and subsequently mediated their migrations. It focuses on how they dealt with their escape in their art and science. The chapters ask how the emigrants located themselves––did they associate with ethnic, religious, and/or cultural affiliations, specific social classes, or specific parts of society—and how such identifications were portrayed in their knowledge transfer and cultural translations. This book considers the history of the Prester John legend and its impact on the Crusades, investigating its entangled mythical history between East and West during the twelfth and thirteenth centuries. The present study thus responds to the still pressing need for a comprehensive historical investigation of the twelfth and thirteenth crusading history of the legend and its impact on the Muslim-Crusader encounters, examining various Latin, Arabic, Syriac, and Coptic accounts. It further reflects on new eastern aspects of the legend, presenting a new Arab scholarly view. This book first charts a pre-history of the legend in the late ancient Christian prophecy of the Last Emperor down to the emergence of the legend in the mid-twelfth century. Second, the work presents a historical discussion of the legend and its association with actual occurrences in the Far East and the Levant, analysing the legend history under the crusading crisis and the imperial papal schism in Europe. Meanwhile, the work considers the vague Prester John Letter addressed to Manuel I Komnenus, Byzantine Emperor, and its elaborate conception of a mythical eastern kingdom, revealing imaginative parallels on the wondrous East and legendary Eastern Christian kings in Arabic Muslim and Christian accounts of the Muslim geographer and cartographer al-Idrisi, the Coptic Abu al-Makarim and the Syriac Ibn al-'Ibri (Bar Hebraeus), among others. Moreover, the book examines how the legend impacted war and peace processes between the Ayyubids and the Crusaders during the Fifth Crusade against Egypt (1217-1221), revealing how it was mingled with Arabic and Eastern Christian prophecies at the time. The study concludes by investigating the perception of Prester John by the papal and European envoys to the Mongols in the thirteenth century, revealing how the legend was instrumentalised (and even weaponised) to establish a Latin-Mongol crusade through a parallel exploration of relevant Latin, Arabic and Syriac sources.

Interdisciplinary in approach, this volume explores and deciphers the symbolic value and iconicity of the built environment in the Arab Gulf Region, its aesthetics, language and performative characteristics. Bringing together a range of studies by artists, curators and scholars, it demonstrates how Dubai appeared - at least until the financial crisis - to be leading the construction race and has already completed a large number of its landmark architecture and strategic facilities. In contrast, cities like the Qatari capital Doha still appear to be heavily ’under construction’ and in countries like the Sultanate of Oman, ultra-luxury tourism projects were started only recently. While the construction of artificial islands, theme parks and prestige sport facilities has attracted considerable attention, much less is known about the region’s widespread implementation of innovative infrastructure such as global container ports, free zones, inter-island causeways and metro lines. This volume argues that these endeavours are not simply part of a strategy to prepare for the post-oil era for future economic survival and prosperity in the Lower Gulf region, but that they are also aiming to strengthen identitarian patterns and specific national brands. In doing so, they exhibit similar, yet remarkably diverse modes of engaging with certain global trends and present - questionably - distinct ideas for putting themselves on the global map.
