Attraverso il dislocamento spaziale viene assoggettato a un regime giuridico che per lui resta in gran parte culturalmente opaco. I codici espliciti – gli obblighi di legge – non lasciano trapelare il vastissimo non detto che presuppongono e custodiscono, il sapere implicito al quale gli autoctoni hanno accesso da sempre e che è portatore di una normatività di diverso genere, ma altrettanto imprescindibile per la convivenza quotidiana. This book proposes an interdisciplinary methodology for developing an intercultural use of law so as to include cultural differences and their protection within legal discourse; this is based on an analysis of the sensory grammar tacitly included in categorizations. This is achieved by combining the theoretical insights provided by legal theory, anthropology and semiotics with a reading of human rights as translational interfaces among the different cultural spaces in which people live. To support this use of human rights’ semantic and normative potential, a specific cultural-geographic view dubbed ‘legal chorology’ is employed. Its primary purpose is to show the extant continuity between categories and spaces of experience, and more specifically between legal meanings and the spatial dimensions of people’s lives. Through the lens of legal chorology and the intercultural, translational use of human rights, the book provides a methodology that shows how to make space and law reciprocally transformative so as to create an inclusive legal grammar that is equidistant from social cultural differences. The analysis includes: a critical view on opportunities for intercultural secularization; the possibility of construing a legal grammar of quotidian life that leads to an inclusive equidistance from differences rather than an unachievable neutrality or an all-encompassing universal legal ontology; an interdisciplinary methodology for legal intercultural translation; a chorological reading of the relationships between human rights protection and lived spaces; and an intercultural and geo-semiotic examination of a series of legal cases and current issues such as indigenous peoples’ rights and the international protection of sacred places.

This book argues that the effective protection of fundamental rights in a contemporary, multicultural society requires not only tolerance and respect for others, but also an ethics of reciprocity and a pursuit of dialogue between different cultures of human rights. Nowadays, all cultures tend to claim an equitable arrangement that can be articulated in the terms of fundamental rights and in the multicultural organization of the State. Starting from the premise that every culture is and always was intercultural, this book elaborates a new, and more fundamentally, pluralist view of the relationship between rights and cultural identity. No culture is pure; from the perspective of an irreducible cultural contamination, this book argues, it is possible to formulate constitutional idea of diversity that is properly intercultural. This concept of intercultural constitutionalism is not, then, based on abstract principles, but nor is it bound to any particular cultural norm. Rather, intercultural constitutionalism allows the interpretation of rights, rules and legal principles, which are established in different contexts.

The provision of Islamic kafala has no legal correspondence with secularised political systems and structures, and, as a result, requires a proper understanding of the legislative measures that are indispensable for the protection of the weakest groups of society, at least when the latter turn out to be mostly vulnerable or abandoned. Most recent international conventions have placed much emphasis on the priority to be given to child protection rather than other personal interests. While no syntagmatic principle exists for a theoretical definition and boundary of religious freedoms and legal rules affecting Islamic kafala, it has become a prevailing interpretative canon which requires the scholar to aim for a proper understanding of the cultural identities and measures to safeguard individuals concerned. The complex legal situations arising from the coexistence of international law, state law, and social and religious norms in different parts of the world often include scenarios of conflict between them. These conflicting norms issued from different categories of ‘laws’ result in difficulties in describing, identifying and analysing human rights in plural environments. This volume studies how normative conflicts unfold when trapped in the aspirations of human rights and their local realizations. It reflects on how such tensions can be eased, while observing how and why they occur. The authors examine how obedience or resistance to the official law is generated through the interaction of a multiplicity of conflicting norms, interpretations and practices. Emphasis is placed on the actors involved in raising or decreasing the tension surrounding the conflict and the implications that the conflict carries, whether resolved or not, in conditions of asymmetric power movements. It is argued that legal responsiveness to state law depends on how people with different identities deal with it, narrate it and build expectations from it, bearing in mind that normative pluralism may also operate as an instrument towards the exclusion of certain communities from the public sphere. The chapters look particularly to expose the dialogue between parallel normative spheres in order for law to become more effective, while investigating the types of socio-legal variables that affect the functioning of law, leading to conflicts between rights, values and entire cultural frames.

Negli ultimi anni si è sovente parlato di de-secolarizzazione. Al tempo stesso, tuttavia, non si è mai spenta la voce di chi afferma che la modernità ha inaugurato un'epoca in cui la religione è in via di estinzione e la secolarizzazione ha vinto la partita della storia. Se così fosse, un libro sullo 'spazio religioso’ sarebbe poco più che un testo su un tema di nicchia. C’è da chiedersi, tuttavia: lo 'spazio religioso' può davvero considerarsi scisso e categoricamente distinguibile dallo spazio in generale? Le città europee sono state storicamente costruite intorno a una chiesa collocata accanto alla sede del governo, generando a sua volta lo ‘spazio' della piazza pubblica principale. Nella maggior parte dei siti urbani, questa distribuzione topografica urbana permane, e l’Italia costituisce, da questo punto di vista un esempio paradigmatico. Proprio in Italia, i conflitti sull’utilizzo delle chiese cattoliche in disuso, sulle comunità musulmane che necessitano di spazi per la preghiera, sugli spazi interreligiosi e sul connesso uso dello spazio urbano nel suo complesso, riflettono preoccupazioni pressanti su come vivere le nostre città, sempre più plurali, e su come definire i confini tra la libertà degli uni e la libertà degli altri. Su questo terreno di scontro entra in gioco il diritto, che regola lo spazio e tutte le pratiche che si svolgono al suo interno. La ‘liturgia’, intesa attraverso la sua radice etimologica di ‘azione nello spazio pubblico,’ serve come chiave ricostruttivo-cognitiva che potrebbe supportare il diritto a qualificare in modo più adeguato gli oggetti e i destinatari della regolamentazione da esso offerta. Se il tempo e lo spazio sono impossibili da separare, guardare indietro è l'unico modo per scandagliare il futuro (e viceversa). A questo scopo, nel testo vengono offerte alcune brevi incursioni storiche accanto all'analisi giuridica dell’esperienza contemporanea, e ciò con l’obiettivo di illuminare un percorso possibile verso un orizzonte di giustizia spaziale. Nei tre capitoli che lo compongono, il volume tratta rispettivamente del rapporto tra spazio sacro e spazio secolare della città; delle questioni teorico-giuridiche e giurisdizionali che ruotano attorno al problema della disponibilità dei luoghi di culto all’interno del tessuto urbano; e, infine, dei presupposti storici e metodologici per l’elaborazione di una ‘giustizia spaziale’ costituzionale.
