Dans la pensée contemporaine, l’esclavage est considéré comme un crime contre l’humanité, parce qu’il nie des droits universellement reconnus (la liberté, l’égalité), en faisant de l’être humain une propriété, un objet. Pourtant, l’affirmation de l’homme en tant qu’être juridique porteur de droits subjectifs est historiquement et culturellement marquée. Il a pu exister, même en droit français, un droit objectif de l’esclavage. Cette réalité conduit à s’interroger sur la logique de légitimation de l’esclavage, et à l’inverse sur l’émergence d’une définition juridique de l’homme comme sujet de droit. Le centre « Éthique et procédures » et la faculté de droit Alexis de Tocqueville (Université d’Artois), à l’initiative de Manuel Carius et de Tanguy Le Marc’hadour, ont invité juristes de droit public ou de droit privé et historiens du droit à réfléchir sur les rapports du droit et de l’esclavage. Leurs contributions, limitées à l’espace juridique français, mais étudiant des époques et des lieux variés, analysent le code noir et ses évolutions, ou le droit international contemporain, en passant par le droit du protectorat marocain ou le statut de l’indigène en Algérie. Le droit de l’esclavage ayant longtemps cohabité avec son interdiction, on constate un relativisme juridique qui lui donne des contours imprécis, sur deux points : il fait de l’esclave un être juridique hybride, à la fois chose et homme, dont le statut varie avec le temps, et il désigne aussi « l’autre humanité », susceptible d’être mise en esclavage, et « l’autre lieu », l’ailleurs où existera l’esclavage. Il crée alors une altérité mouvante qui prend des formes différentes selon les époques et les lieux. Les contributeurs du colloque présentent ainsi une réflexion sur un droit pris entre exigence morale et intérêts économiques ou sécuritaires.

Blandine Kriegel, at one time a collaborator with Michel Foucault, is one of France's foremost political theorists. This translation of her celebrated work L'Etat et les esclaves makes available for English-speaking readers her impassioned defense of the state. Published in France in 1979 and republished in 1989, this work challenged not only the anti-statism of the 1960s but also generations of romanticism in politics that, in Kriegel's view, inadvertently threatened the cause of liberty by refusing to distinguish between the despotic and the lawful state. In a work that addresses the urgent concerns of Europe and the contemporary world as a whole, Kriegel examines the background of modern liberal democracy in the late seventeenth and eighteenth centuries and argues cogently for the future of constitutional social-democracy. She maintains, among other positions, that European liberal democracies would have been impossible without the political basis provided by the lawful state first developed by monarchies. She also shows that early modern centralized states became liberal insofar as they developed a centralized legal system, rather than a centralized administration. In developing these ideas, she presents a picture of the state as a major force for human liberty.

The forced migration of Africans to the Americas through the trnasatlantic slave trade created primary centres of settlement in the Caribbean, Brazil and the United States - the cornerstones of the New World and the black Americas. However, unlike Brazil and the US, the Caribbean did not (and still does not) have the uniformity of a national framework. Instead, the region presents differing situations and social experiences born of the varying colonial systems from which they were developed. Using the Caribbean experience as the focus, Christine Chivallon examins the transatlantic slave trade and slavery as founding events in the identification of a black diaspora experience. The exploration is extended to include the United States to exemplify contrasting situations in slavery-based systems and identifies the links between the expressions of culture emanting from the black populations of the New World and the diversity of interpretations of the cultural identities of the black Americas.Divided into three main parts, The Black Diaspora of the Americas firstly examines the foundation of the black experiences of the New World by considering the slave trade. It is well-known that in Brazil and in the Caribbean area, Negroes do not suffer legal or even major social disabilities on account of color, and that a long history of acceptance and miscegenation has erased the sharp line between white and colored. Professor Tannenbaum, one of our leading authorities on Latin America, asks why there has been such a sharp distinction between the United States and the other parts of the New World into which Negroes were originally brought as slaves. In the legal structure of the United States, the Negro slave became property. There has been little experience with Negro slaves in England, and the ancient and medieval traditions affecting slavery had died out. As property, the slave was without rights to marriage, to children, to the product of his work, or to freedom. In the Iberian peninsula, on the other hand, Negro slaves were common, and the laws affecting them were well developed. Therefore, in the colonies of Spain and Portugal, while the slave was the lowest person in the social order, he was still a human being, with some rights, and some means by which he might achieve freedom. Only the United States made a radical split with the tradition in which all men, even slaves, had certain inalienable rights.
