The chapters in this volume are based on the papers that were presented at a seminar in March 1994 organized under the auspices of the newly established ILA Committee on Legal Aspects of Sustainable Development. The seminar focused on the legal principles and international practice of sustainable development and good governance as one of its constitutive elements. The book is divided into four parts: Evolution of Concepts, Participatory Development, Development Cooperation and Human Rights, and Sensible Economic and Social Policies. They reflect the holistic concept of sustainable development advanced by the International Union for the Conservation of Nature sustainable development. This concept implies that maintaining a quality of life for many generations is socially desirable, economically viable and ecologically sustainable. The volume highlights the principle of sustainable development as a major topic in international law embodied in the international instruments agreed upon at the UN Conference on Environment and Development in Rio de Janeiro (1992). The introductory chapter discusses the interlinking of development and good governance, including human rights, democracy, and sensible economic and social policies as presented in the 1994 UN Agenda for development. The management of the economy, society and environment towards sustainability will be one of the most momentous discussions of our times. According to one author sustainable development is incompatible with continuous growth of the economy, while good governance appears to be incompatible with the achievement, within a reasonable time scale, of a non-growth society. Sustainable development stirs up debate about the capacities of political steering and governance. The complexity of the task expounds limits of steering in three dimensions: goals, knowledge, and power: Sustainability goals are subject to changing and controversial risk perceptions, values and interests. Moreover, knowledge of the coupled dynamics of society, technology and nature is limited. Finally, the power to shape structural change in society and technology is distributed across a multitude of actors and societal subsystems. Steering attempts therefore have to cope with conflict and ambivalence, with uncertainty, and with a lack of central control; and they have to face the necessity of coordinating different actor groups and social networks. This volume explores steering strategies and governance arrangements for sustainable development with a view to these problem dimensions. The contributions by authors from various disciplines approach these challenges from different conceptual angles, ranging from positivist, managerial up to post-modern, constructivist perspectives. By combining theoretical reflections with insights from empirical research in European and American contexts, the volume maps out conditions and identifies approaches which both reflect the limits of steering and reveal options for constructively taking up the task of sustainable development in science and practice.

This is the twentieth in the annual series assessing major development issues. The report is devoted to the role and effectiveness of the state:what it should do, how it should do it, and how it can improve in a rapidly changing world. Governments with both centrally-planned and mixed economies are shrinking their market role because of failed state interventions. This report takes an opposite stance:that state's role in the institutional environment underlying the economy, that is, its ability to enforce a rule of law to underpin transactions, is vital to making government contribute more effectively to development. It argues against reducing government to a minimalist state, explaining that development requires an effective state that plays a facilitator role in encouraging and complementing the activities of private businesses and individuals. The report presents a state reform framework strategy:First, focus the state's activities to match its capabilities; and second, look for ways to improve the state's capability by re-invigorating public institutions. Successful and unsuccessful examples of states and state reform provide illustrations.
