Buku ini mengulas tentang perubahan yang terjadi dalam masyarakat adat Minangkabau di Sumatera Barat, yang menjadikannya masyarakat Minangkabau yang komunal menjadi masyarakat yang individual. Perubahan ini mengakibatkan berubahnya tatanan kehidupan masyarakat adat Minangkabau yang sudah membumi. Bab 1 menyajikan tentang teori-teori kajian hukum dan perubahannya dalam, masyarakat dan struktur nagari secara umum. Bab 2 dari buku ini menggambarkan tentang sejarah dan kehidupan masyarakat adat Minangkabau yang komunal dalam bernagari. Perubahan masyarakat adat Minangkabau disajikan pada Bab 3 dan Bab 4 dalam buku ini. Semua perubahan disesuaikan dengan data-data yang akurat dengan menampilkan fakta-fakta yang terjadi di lapangan. Adapun gambaran yang terdapat dalam dua bab di atas adalah dominasi hukum negara, masyarakat adat yang komunal menjadi masyarakat yang individual beserta faktor-faktor perubahannya, keterikatan struktur hukum dengan struktur pemerintahan nagari, kebijakan pemerintah dalam nagari dan perubahan struktur kelembagaan masyarakat nagari. Pada Bab 5 menyajikan tentang penyatuan konsep antara hukum adat dan hukum negara. Bab ini menjelaskan langkah-langkah apa yang harus dilakukan pemerintah nagari dan pemerintah pusat untuk menentukan arah kebijakan dalam mengatur suatu daerah. Penentuan arah kebijakan harus disesuaikan dengan prinsip-prinsip yang berlaku khusus dalam suatu daerah yang memiliki ciri khas yang berbeda dari daerah lainnya. Selain itu menjadikan hukum negara sebagai alat perlindungan bagi hukum adat agar tetap dapat melestarikan tradisi dan budaya yang sudah ada dan tumbuh lama dalam suatu daerah tertentu. Ketegasan pemerintah dalam memberikan ruang bagi hukum adat untuk tumbuh dan berkembang sangat diperlukan agar konflik-konflik yang ada bisa teratasi secara baik dan benar.

This book deals with the property and inheritance system of the matrilineal Minangkabau of West Sumatra in the context of legal pluralism. The author proposes a new anthropological approach to law, property and inheritance. After the description of the Minangkabau socio-political organization and the development of legal and administrative pluralism, three chapters are devoted to property and inheritance proper. First the ideal legal systems are described. Then he illustrates how the Minangkabau actually handle their property and inheritance affairs, and how the various regulating mechanisms have changed through history. Finally the different agents creating and changing legal conceptions are treated in historical perspective. In his conclusions the author shows how the traditional system of common holding and distributing of property by matrilineal descent groups is slowly being undermined through an increasing monetarization and consequent individualization of property relationships which finds its expression in the form of new legislation. This development is reflected in the conceptual system where the formerly predominant diachronic dimension of property relationships is slowly abolished and where property rights are increasingly reified.
