Studienarbeit aus dem Jahr 2022 im Fachbereich Führung und Personal - Sonstiges, Note: 1,3, Hochschule Fresenius; Köln, Sprache: Deutsch, Abstract: In der vorliegenden Arbeit wird das Verfahren des BEM in seinen Grundzügen und wichtigsten Inhalte dargestellt. Anschließend werden zwei ermittelte Risiken mit ihren gesetzlichen Grundlagen und Würdigungen näher betrachtet, um anschließend die zweifelsohne vorhandenen Chancen zu beleuchten, die sich für den Arbeitnehmer aus einem erfolgreichen BEM-Verfahren ergeben. Im Zuge der Reform des Bundesteilhabegesetzes wurde auch das BEM neu geregelt. Zunächst wurde die Definition von Behinderung dem Wortlaut der UN-Behindertenkonvention angepasst (§ 2 I SGB IX). Der § 84 Abs. 2 SGB IX war die Gesetzesgrundlage für das BEM und ist nun leicht abgewandelt im § 167 SGB IX aufgegangen. Mit der Reform hat der Gesetzgeber die Rehabilitationsträger stärker in die Pflicht genommen. Daher ist seit dem 01.01.2018 derjenige Rehabilitationsträger zuständig, der zuerst angegangen wird. Der Arbeitgeber ist im Verfahren des BEM aufgefordert, sofern notwendig, die Rehabilitationsträger und bei schwerbehinderte Arbeitnehmern die Integrationsämter verpflichtend hinzuzuziehen. § 176 SGB IX benennt die beteiligten Interessenvertretungen und § 44 SGB IX regelt den Anspruch auf stufenweise Wiedereingliederung der gesundeten Arbeitnehmer. Im Zuge der gesetzlichen Neuregelung und der Verantwortungsübertragung an die Rehabilitationsträger (v.a. Deutsche Rentenversicherung, Unfall- und Krankenkassen, Verband der Ersatzkrankenkassen) stellen diese für Arbeitgeber und Arbeitnehmer eine Vielzahl an Publikationen zur Verfügung, die in Form von Planungshilfen, Leitfäden und praktischer Beratungsleistung die Ausführung des BEM unterstützen sollen. Zugleich existiert eine umfassende Rechtsprechung zur Umsetzung des BEM als Arbeitgeberpflicht. Ablauf und Ergebnis des BEM sind von den individuell verschiedenen Fallkonstellationen abhängig.
