Two different sanctioning systems are applicable to young adult offenders in Germany: juvenile criminal law and adult criminal law. The present study provides an overview of the various sanctions applied to these adolescents aged between 18 and 20 and of their reconvictions during an observation period. Based on data from the German Federal Central Criminal Register (Bundeszentral- und Erziehungsregister), the study covers all convictions and juvenile diversional measures in a specific reference year. This data set allows a detailed examination of the applied sanctions and measures, the proportion of juvenile and adult criminal law, and the reconviction rate differentiated by gender, age, offence and other variables. The empirical analysis also addresses regional differences in sanctioning and examines, if juvenile criminal law is “milder” and/or more effective than adult criminal law – questions that play an essential role in the debate on suitable sanctions for young adults.

English summary: The purpose of the Correctional Custody Law was to commit antisocial persons (for example prostitutes) to closed welfare institutions. For the first time, Matthias Willing describes in detail the history of this repressive law in the Weimar Republic, during National Socialism, in the Western occupation zones and the Federal Republic of Germany until compulsory correctional custody was prohibited by the Federal Constitutional Court in 1967. In doing so, he shows that there was continuity in the fundamental directions which German welfare services took for socially disadvantaged persons in the 20th century. German description: Matthias Willing untersucht die Bemuhungen von offentlicher und privater Fursorge in Deutschland, ein eBewahrungsgesetz' zu schaffen. Mit diesem Gesetz sollten Randgruppen der Gesellschaft, die vielfach als eAsoziale' diskriminiert wurden, zwangsweise in geschlossenen Fursorgeanstalten untergebracht und zu geregelter Arbeit angehalten werden konnen. Nachdem in der Weimarer Republik zahlreiche Initiativen zu seiner Verwirklichung gescheitert waren, versuchten die Fachkreise der Gefahrdetenfursorge erfolglos eine repressivere Variante des Bewahrungsgesetzes im Nationalsozialismus durchzusetzen. Sofort nach dem zweiten Weltkrieg verfolgte man die Bewahrungsidee in den Westzonen und der Bundesrepublik weiter. Diese Bemuhungen wurden schliesslich 1961 mit der Aufnahme einer Zwangsbewahrungsmoglichkeit im Bundessozialhilfegesetz ( 73 Abs. 2 BSHG) von Erfolg gekront. Erst 1967 erklarte das Bundesverfassungsgericht die zwangsweise Unterbringung egefahrdeter' Personen in geschlossenen Anstalten grundsatzlich fur verfassungswidrig. Die rechtshistorische Analyse des Autors zeichnet diesen rund 50 Jahre umfassenden Prozess nach, beleuchtet Konzeptionen und Motive fuhrender Personlichkeiten der Fursorge und zeigt gedankliche und personelle Kontinuitaten von der Weimarer Republik uber den Nationalsozialismus in die Bundesrepublik der 60er Jahre auf. Indem auch die politischen Parteien und weitere Akteure ausserhalb der Gefahrdetenfursorge (z. B. Frauenbewegung, Psychiater) in ihren Bemuhungen fur das Bewahrungsgesetz mit einbezogen werden, entsteht ein facettenreiches Gesamtbild. Es lasst erkennen, dass die autoritaren Gedanken des Bewahrungsgesetzes im Untersuchungszeitraum breite Akzeptanz in der Gesellschaft besassen.
