English summary: For some time now administrative law has been increasingly confronted with far-reaching efforts for reform. These efforts have been directed in particular at environmental law. In this field, the interests of both the population and the economy in playing an active part in forming the environment cause repeated conflicts with the interest of individuals and the general public in protecting the environment, and it is these opposing measures which must be reconciled. One way of coping with this conflict would be to refrain from prohibiting certain pursuits of personal liberty, even if this prohibition were justified, if the detrimental effects of this pursuit of liberty on the legal interests of a third party or on the public interest could be offset adequately. Andreas Vosskuhle attempts to reveal the many facets contained in the paradigmatic potential of the concept of compensation. He gives a theoretical basis for this and makes it part of a general theory of compensation. German description: Seit einiger Zeit sieht sich das Verwaltungsrecht verstarkt mit tiefgreifenden Reformbestrebungen konfrontiert. Besondere Aufmerksamkeit gilt dabei dem Umweltrecht. Dort mussen die aktiven Gestaltungsinteressen der Burger und der Wirtschaft immer wieder aufs Neue mit den kollidierenden Verschonungs- und Schutzinteressen Einzelner und der Allgemeinheit in Einklang gebracht werden. Eine Moglichkeit, diese Kollisionslage zu bewaltigen, besteht darin, von einem an sich gerechtfertigten Verbot bestimmter Freiheitsbetatigungen dann abzusehen, wenn die durch die Freiheitsbetatigung verursachten nachteiligen Auswirkungen auf Rechtsguter Dritter oder das Gemeinwohl angemessen kompensiert werden. Unterschiedliche Ansatze fur ein solches konkretes Ausgleichsdenken finden sich bereits im Naturschutz-, Wasser-, Immissionsschutz-, Abfall- und Planungsrecht. Sie dienen Andreas Vosskuhle als Grundlage bei dem Versuch, das paradigmatische Konfliktlosungspotential des Kompensationsgedankens fur eine flexible Verwaltungsrechtsordnung in seiner ganzen Vielfalt zu erschliessen, theoretisch zu fundieren und in eine allgemeine Kompensationsdogmatik zu uberfuhren. This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court ́s approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. This English translation makes available to anglophone readers a modern classic of German tort theory. It argues that modern German tort law is faced with doctrinal tensions based on problematic theoretical assumptions which stem from historical conceptions of tortious liability, inappropriate to modern times. From a theoretical perspective, it argues against the prevalent doctrinal view in Germany that conceives of tortious liability as split between two tracks - a fault-based track and a strict liability track - each with different normative foundations. Instead, Jansen asserts that there is no rigid distinction between the normative foundations of each form of liability. Rather, both fault liability and strict liability in German law, and indeed other European systems, are best considered as resting upon the unifying theoretical structure of outcome responsibility. The ever-increasing release of harmful agents due to human activities have led in some areas of the world to heavy pollution. In order to protect human health and the environment, environmental standards that shall limit the release and the concentration of those toxic agents in the environment and hence the exposure to it have to be established. The related assessment and decision-making procedures have to be based on solid scientific data about the effects and mechanisms of these agents as well as on ethical, social and economic aspects. For risk evaluation, the knowledge of the dose response curve is an essential prerequisite. Dose responses without a threshold dose are most critical in this connection. Such dose responses are assumed for mutagenic and carcinogenic effects, which, therefore, dominate also the discussion in this book. In the environmentally important low dose range, risk estimation can only be achieved by extrapolation from higher doses with measurable effects. The extrapolation is accompanied with uncertainties which makes risk evaluation as well as risk communication frequently problematic. In order to ensure rational efficient and fair decisions beyond a sound scientific assessment the dialogue between disciplines, with the affected people and with the general public is necessary. In this book, the whole range of relevant and essential aspects of risk evaluation and standard setting is addressed. Starting with the ethical foundations, the sound analysis of recent scientific findings sets the frame for further reflections by theory of cognition, psychosocial sciences, and jurisprudence. The authors end up with concluding recommendations for coping with the recent problems of standard setting in the field of environmentally relevant low doses.
