Die Funktion eines Gerichtsverfahrens besteht aus juristischer Sicht primär in der ‘Durchsetzung der objektiven Rechtsordnung’. Das beinhaltet im Anschluss an die Feststellung des individuellen Straftatbestandes eine gerechte, also rechtmäßige Bestrafung des Täters. Somit hat ein Gerichtsverfahren, neben der juristischen Funktion, ebenso eine gesellschaftliche Funktion: Es stellt die Sühne des Verbrechens durch den Täter sicher. Der Oradour-Prozess 1953 in Bordeaux, bei dem Angehörige eines SS-Verbandes wegen Mordes an 642 Bewohnern eines kleinen französischen Dorfes - dem Massaker von Oradour - angeklagt waren, hatte große Schwierigkeiten diesen Anforderungen gerecht zu werden. Die Tatsache, dass in diesem SS-Verband Franzosen aus dem Elsass am Massenmord beteiligt waren, machte es dem Gericht, durch den sich daraus entwickelnden innerfranzösischen Eklat, beinahe unmöglich, ein von äußeren Umständen unabhängiges und vor allem rechtmäßiges Urteil zu fällen. Juristisch fußte der Prozess nämlich auf einem äußerst umstrittenen Fundament: der nach dem Oradour-Massaker benannten ‘lex Oradour’-Verordnung, die das Prinzip der Kollektivschuld ermöglichte. Die Elsässer sind zum Großteil in die SS zwangsrekrutiert worden, weshalb der Prozess in Bordeaux von Protesten von elsässischer Seite gegen die Gleichbehandlung mit den Deutschen begleitet war. Die Frage, die der vorliegenden Arbeit zugrunde liegt, lautet: Wie reagierte die deutsche Öffentlichkeit angesichts dieser widrigen Begleitumstände auf das Gerichtsverfahren in Frankreich, bei dem die Hinterbliebenen der Opfer einhellig die Todesstrafe für alle deutschen und französischen Angeklagten forderten? Um diese Frage zu beantworten, wurden die Berichterstattung und die Kommentare in der bundesdeutschen Presse zum Oradour-Prozess untersucht. Lag der Fokus der deutschen Rezeption auf dem Schicksal der deutschen Angeklagten oder auf der Rechtmäßigkeit des gesamten Verfahrens? Zeigte man sich beschämt ob des von Nazideutschland zu verantwortenden Verbrechens? Wie wurde in Deutschland auf die elsässischen Proteste reagiert? Welcher Stellenwert wurde dem Prozess im Hinblick auf die zukünftigen deutsch-französischen Beziehungen beigemessen? Diese Fragen versucht diese Arbeit zu klären.

Conventional depictions of occupation and collaboration in World War II, of wartime resistance and post-war renewal, provided the familiar backdrop against which the chronicle of post-war Europe has mostly been told.
