Die Europaische Gemeinschaft ond die Europaische Union nach dem Vertrag von Maastricht Professor Dr. Christoph Vedder Seit der Grtindung der Europaischen Wirtschaftsgemeinschaft zum 1. Januar 1958 ist der Grtindungsvertrag der EWG, der wichtigsten der drei europaischen Gemeinschaften EWG, EAG und EGKS, einige Male geandert worden. 1967 wurde durch den Fusionsvertrag ein ge meinsamer Rat und eine gemeinsame Kommission fUr aile drei Ge meinschaften eingesetzt, nachdem bereits seit der Grtindung das Parla ment und der Gerichtshof als gemeinsame Organe der Gemeinschaften fungierten. Die Fusionsverfassung, durch die die drei Gemeinschaften auch als Organisationen verschmolzen worden waren, ist nicht zustan degekommen. Seit 1970 wurden in mehreren Etappen die Finanzvor schriften des EWG-Vertrages in Richtung auf die Finanzierung durch eigene Einnahmen und auf die EinfUhrung eines Budgetrechts des Europaischen Parlaments hin geandert. Der Beitritt GroBbritanniens, Danemarks - mit dem spateren "Austritt" Gronlands - und Irlands 1973, der Beitritt Griechenlands 1981 sowie Spaniens und Portugais 1986 hatten Anderungen der institutionellen Vorschriften zur Foige. Von groBem politischen Gewicht fUr die Integration ist die schrittweise Starkung der Stellung und die Erweiterung der Kompetenzen des Euro paischen Parlaments: 1976 die Einftihrung allgemeiner und direkter Wahlen, die seit 1979 in fUnfjahrigem Rhythmus stattfinden; das Bud getrecht des Parlaments. Dennoch blieb das Europaische Parlament weit davon entfernt, ein Parlament mit solchen Kompetenzen zu sein, wie man es von einem nationalen Parlament gewohnt ist. 1

During recent years, constitutional issues have claimed increasing attention in many European countries. The social and political transformations in Central and Eastern Europe have thrust constitutional debates to the fore. Common European Legal Thinking emanates from the existence of a shared European legal culture as especially reflected in the existence of a common European constitutional law. It denotes a body of individual constitutional principles – written and unwritten – that represent the common heritage of the constitutions of the Member States. Taking into account the two major European organisations, the Council of Europe and especially the European Union, the essays of this Festschrift discuss a range of constitutional principles, including the rule of law, democracy, and the exercise of political power in a multilevel system which recognises fundamental rights as directly applicable and supreme law.
