Doch was es genau bedeutet eine „bahnbrechende Erfindung“ zu entdecken und wie man sie einsetzt, um einen Nutzen daraus zu erhalten, ist oft nicht bekannt. In Deutschland gilt, wie in vielen anderen Ländern, die Nachahmungsfreiheit. Neue Erzeugnisse, Verfahren, Designs und sogar Marken dürfen normalerweise nachgeahmt werden. Infolgedessen hilft gegen Konkurrenz meist nur die rechtzeitige Anmeldung eines gewerblichen Schutzrechts, um eigene technische Neuentwicklungen, Produktgestaltungen und erfolgreiche Marken zu schützen. Die Belohnung für die geleistete Kreativität und Investition, ist der Schutz gegen Nachahmung und Ideenklau von Wettbewerbern, die der Inhaber erhält. Gerade im Hinblick auf den wachsenden europäischen und internationalen Markt gewinnen die Schutzrechte immer mehr an Bedeutung. Auf der einen Seite bedeutet für die Wirtschaft ein Wachstum der Märkte eine verstärkte Konkurrenz. Doch auf der anderen Seite bietet sie auch Chancen, neue Märkte zu erschließen. Hier gilt gerade für kleine und mittelständige Unternehmen ihre Marktposition durch Schutzrechte abzusichern oder gar auszubauen. Somit stellen Schutzrechte primäre Bestandteile eines Unternehmen dar, das Produkte herstellt, vertreibt oder Verfahren entwickelt - Schließlich hat ein Unternehmen auch einen Ruf zu verlieren. In meiner Betriebswirtarbeit möchte ich die Schutzrechte und besonders das Patent behandeln, die einem Unternehmen zur Verfügung stehen. Jeder kennt zwar das Patent, doch was es wirklich bedeutet ein Patent anzumelden und welchen Umfang ein Patent besitzt, versuche ich hier näher zu erläutern. Nicht alle Aspekte des Patentschutzes und anderer Schutzrechte können beleuchtet werden, dies würde den Rahmen dieser Betriebswirtarbeit überschreiten. Aber auf die wichtigsten Schritte des Patentschutzes werde ich sorgfältig eingehen.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

Dr. Neal Lane, Advisor to the President for Science and Technology and former National Science Foundation (NSF) director, stated at a Congressional hearing in April 1998, "If I were asked for an area of science and engineering that will most likely produce the breakthroughs of tomorrow, I would point to nanoscale science and engineering. Timely information on scientific and engineering developments occurring in laboratories around the world provides critical input to maintaining the economic and technological strength of the United States. A substantial number of these studies have been conducted by the World Technology Evaluation Center (WTEC) managed by Loyola College through a cooperative agreement with NSF. The National Science and Technology Council (NSTC), Committee on Technology's Interagency Working Group on NanoScience, Engineering and Technology (CT/IWGN) worked with WTEC to develop the scope of this Nanostucture Science and Technology report in an effort to develop a baseline of understanding for how to strategically make Federal nanoscale R&D investments in the coming years. The purpose of the NSTC/WTEC activity is to assess R&D efforts in other countries in specific areas of technology, to compare these efforts and their results to U. S. research in the same areas, and to identify opportunities for international collaboration in precompetitive research. Many U. S. organizations support substantial data gathering and analysis efforts focusing on nations such as Japan. But often the results of these studies are not widely available.
