The book deals with the expansion and institutionalization of intellectual property norms in the twentieth century, with a European focus. Its thirteen chapters revolve around the transfer, adaptation and the ambivalence of legal transplants in the interface between national and international projects, trends and contexts. Who owns inventions developed at US research universities? And who benefits from the current ownership regime? To answer these questions, Anna Marion Bieri discusses the transformation which has taken place in academia in regard to the involvement and commercialisation of patents and the effect university patenting has had on the academic mission and the scientific commons. Special emphasis is placed on the history and implementation of the Bayh-Dole Act - a widely-discussed law which facilitated the patenting and commercialisation of federally funded university inventions. On this basis, the author explores who should benefit from university inventions and how the current ownership regime should be modified to achieve this purpose. Finally, Anna Marion Bieri proposes that universities employ patents strategically in accordance with their research strengths.

Although patents existed in Renaissance Italy and even in Confucian thought, it was not until the middle third of the nineteenth century that architects embraced the practice of patenting in significant numbers. Patents could ensure, as they did for architects’ engineering brethren, the economic and cultural benefits afforded by exclusive intellectual property rights. But patent culture was never directly translatable to the field of architecture, which tended to negotiate issues of technological innovation in the context of the more abstract issues of artistic influence and formal expression. In Prior Art, scholar Peter Christensen offers the first full-scale monographic treatment of this complex relationship between art and invention. Christensen’s method, a site-oriented approach steeped in multinational and multilingual archival work, is geared toward unifying fractured global histories of architectural patents through the distinct union of architectural, cultural, and legal history. The question of how German government agencies and ministries had been dealing with the Nazi-Past in the immediate aftermath of the war, has most recently attracted a high amount of attention. This development was stimulated by the study "Das Amt", published in 2010, discussing the Nazi-Past of the German Foreign Office. Continuity and changes in terms of institutions and personnel have been put into the focus of the discussion as well as substantive aspects of the policy of the first post-war governments in Germany. Several federal ministries and agencies have established commissions, in order to research their own history through independent scholars. Also the Federal Ministry of Justice has chosen this way in order to learn more about its national-socialist continuities.The several articles of this volume address different aspects of the way from the Nazi-legal system to the judiciary of the early Federal Republic of Germany. A main focus is put on the development of the Federal Ministry of Justice, which was residing in the so called Rosenburg in Bonn from 1950-1973. Issue is taken with questions of personnel, like recruitment and promotion policies, but also with crucial issues of legal policy, like the development of the German Constitution after 1948/49, the legislative power in the "Third Reich" and the early Federal Republic of Germany, the prosecution of war criminals in the immediate aftermath of the war, the beginning of criminal law policy in the Ministry as well as the developments in economy and family law.The "Independent Academic Commission at the Federal Ministry of Justice for the critical study of the national socialist past", so named by its official title, has hosted an academic symposium on April 26, 2012 in the "Kammergericht" in Berlin. The papers collected in this volume were mostly presented at that one-day symposiu.

English summary: The German Patent Act 1877 was based on the first-to-file principle and did not ask who the true inventor was. This changed in 1936 when the National Socialist government's reform bill recognized the rights of the true inventor. The provisions introduced are still valid today. Alexander K. Schmidt traces the origins and aims of this fundamental reform. Relying upon both published and unpublished material, he shows the history of the reform bill from its early beginnings in the Empire to the Weimar Republic and then to the era of National Socialism. Despite all the political and social changes, this development was characterized by an astonishing continuity. On this basis, the author analyzes the Patent Act 1936 and classifies it in the context of National Socialist economic legislation German description: Das Patentgesetz von 1877 gewahrte dem ersten Anmelder einer Erfindung das Patent, gleichgultig ob dieser auch der Erfinder war.
