Studienarbeit aus dem Jahr 2015 im Fachbereich Jura - Rechtsphilosophie, Rechtssoziologie, Rechtsgeschichte, Note: 16,00, Friedrich-Alexander-Universität Erlangen-Nürnberg, Sprache: Deutsch, Abstract: Eine ausgewählte Form des „Sich-gegen-die-Staatsgewalt-Stellens“ soll im Folgenden sowohl aus staatsrechtlicher als auch staatsphilosophischer Sicht genauer betrachtet werden: Der Widerstand. Ob „Castor“-Transporte, „Stuttgart 21“, „PEGIDA“ oder (nicht notwendigerweise prominente) Steuerhinterziehung: Situationen, in denen bei einem Teil der Bevölkerung das Bedürfnis geweckt wird, anders zu handeln als vom Staat erwartet, sind genauso unterschiedlich wie unvorhersehbar. Auch wenn eine abschließende Aufzählung unmöglich ist, reichen bereits die genannten Beispiele aus, um beim Großteil der Bevölkerung entsprechende Assoziationen hervorzurufen. Demzufolge fällt es umso leichter, die „Brücke“ zwischen jenen Begriffen zu erkennen: Renitentes, gegen den Staat gerichtetes Verhalten in der Gesellschaft. Wenngleich die oben aufgeführten Ereignisse nicht alltäglich sind und es aus staatlicher Sicht auch nicht sein sollten, können sie dennoch jederzeit aus dem Alltag erwachsen. Entscheidend hierfür ist (zumindest auch) die heutzutage übliche, sekundenschnelle Verbreitung von Informationen via Internet bzw. sozialer Netzwerke. Durch ein so erhöhtes Konsumieren medialer Berichterstattung wird zum einen die eigene Meinungsbildung beschleunigt, zum anderen ist das Ausfindigmachen von Mitbürgern gleicher bzw. ähnlicher Ansichten ebenfalls erleichtert. Eine breite gesellschaftliche Reaktion zu bestimmten (v.a. politischen) Themen innerhalb kürzester Zeit (eben „aus dem Alltag heraus“) erscheint somit nicht mehr verwunderlich. Auch wenn es dabei selten die Gesellschaft als solche ist, die sich durch widerspenstiges Verhalten auszeichnet, können die so agierenden Gruppierungen durchaus selbst als – intern mehr oder weniger einheitliche – „Miniatur-Gesellschaft“ verstanden werden, deren Anliegen es ist, bei der restlichen Bevölkerung Gehör zu finden.

The ascendancy of neo-liberalism in different parts of the world has put social democracy on the defensive. Its adherents lack a clear rationale for their policies. Yet a justification for social democracy is implicit in the United Nations Covenants on Human Rights, ratified by most of the worlds countries. The covenants commit all nations to guarantee that their citizens shall enjoy the traditional formal rights; but they likewise pledge governments to make those rights meaningful in the real world by providing social security and cultural recognition to every person. This new book provides a systematic defence of social democracy for our contemporary global age. The authors argue that the claims to legitimation implicit in democratic theory can be honored only by social democracy; libertarian democracies are defective in failing to protect their citizens adequately against social, economic, and environmental risks that only collective action can obviate. Ultimately, social democracy provides both a fairer and more stable social order. But can social democracy survive in a world characterized by pervasive processes of globalization? This book asserts that globalization need not undermine social democracy if it is harnessed by international associations and leavened by principles of cultural respect, toleration, and enlightenment. The structures of social democracy must, in short, be adapted to the exigencies of globalization, as has already occurred in countries with the most successful social-democratic practices.

This is the first book that documents poverty systematically for the world's indigenous peoples in developing regions in Asia, Africa, and Latin America. The volume compiles results for roughly 85 percent of the world's indigenous peoples. It draws on nationally representative data to compare trends in countries' poverty rates and other social indicators with those for indigenous sub-populations and provides comparable data for a wide range of countries all over the world. It estimates global poverty numbers and analyzes other important development indicators, such as schooling, health, and social protection. Provocatively, the results show a marked difference in results across regions, with rapid poverty reduction among indigenous (and non-indigenous) populations in Asia contrasting with relative stagnation - and in some cases falling back - in Latin America and Africa. Two main factors motivate the book. First, there is a growing concern among poverty analysts worldwide that countries with significant vulnerable populations - such as indigenous peoples - may not meet the Millennium Development Goals, and thus there exists a consequent need for better data tracking conditions among these groups. Second, there is a growing call by indigenous organizations, including the United Nations Permanent Forum on Indigenous Peoples, for solid, disaggregated data analyzing the size and causes of the "development gap."

Federalism has played a central role in charting educational progress in many countries. With an evolving balance between centralization and decentralization, federalism is designed to promote accountability standards without tempering regional and local preferences. Federalism facilitates negotiations both vertically between the central authority and local entities as well as horizontally among diverse interests. Innovative educational practices are often validated by a few local entities prior to scaling up to the national level. Because of the division of revenue sources between central authority and decentralized entities, federalism encourages a certain degree of fiscal competition at the local and regional level. The balance of centralization and decentralization also varies across institutional and policy domains, such as the legislative framework for education, drafting of curricula, benchmarking for accountability, accreditation, teacher training, and administrative responsibilities at the primary, secondary, and tertiary levels. Given these critical issues in federalism and education, this volume examines ongoing challenges and policy strategies in ten countries, namely Australia, Austria, Belgium, Canada, Germany, Italy, Spain, Switzerland, United Kingdom, and the United States. These chapters and the introductory overview aim to examine how countries with federal systems of government design, govern, finance, and assure quality in their educational systems spanning from early childhood to secondary school graduation.
