Konzeptionell-methodischer Rahmen: Im Zentrum dieser Forschungsarbeit steht die Beschreibung der Rolle der EU im System internationaler Organisationen am Beispiel des multilateralen UN-Systems. Diese Dissertation konzentriert sich zentral auf die rechtlichen Aspekte, die für die Beziehungen EU-UN maßgebend sind. Die politischen Verhältnisse bilden lediglich den Hintergrund bzw. den zu regelnden Sachverhalt. In diesem Lichte will diese Studie theoretisch informiert und empirisch fundiert die Rahmenbedingungen, Funktionsweise und Tätigkeiten der EU und der UN sowie das Verhältnis beider Organisationen zu-einander darstellen. Daher wurde für die vorliegende Studie aufgrund der Komplexität der zusammenhängenden Themen die Überlegung einer interdisziplinären Vorgehensweise bevorzugt. Ausgangspunkt: Der Ausgangspunkt des zentralen Rechtsproblems des Verhältnisses zwischen der EU und den Vereinten Nationen wird im Folgenden skizziert: Die UN setzen Staaten (Nationen) als Mitglieder voraus. Sie knüpfen an eine Staatenwelt an, wie sie im Zeitpunkt ihrer Gründung bestand. Die EU ist jedoch kein Staat und daher ein organisatorischer Fremdkörper im UN-System. Dieser Umstand schließt eine Mitwirkung nicht aus, begrenzt aber den Einfluss der EU auf die Willensbildung der UN an der Quelle. Der EU fehlt insb. die Hoheit in militärischen Fragen. Zentrale These: Die EU kann im Kontext der neuen Machtverteilung des 21. Jahrhunderts neben den Machtzentren der Welt nur bestehen, wenn sie eine umfassende kooperationsorientierte Außenpolitik mit globaler Reichweite verfolgt. Allerdings muss sie darauf hinarbeiten, möglichst effektive und nachhaltige Strategien zur Entfaltung der Chancen zu entwickeln sowie um breite Unterstützung zu werben und möglichst viele relevante Akteure für sie zu gewinnen. Dazu benötigt sie nicht nur eine enge und effiziente multilaterale Zusammenarbeit mit internationalen Organisationen auf völkerrechtlicher Ebene, sondern auch eine entsprechende Neugestaltung der Europäischen Verträge, primär ihrer Kompetenzordnung und Außenpolitik. Der Vertrag von Lissabon ermöglicht ihr zwar die rechtlichen und institutionellen Rahmenbedingungen. Es hängt jedoch zentral davon ab, ob sich die Mitgliedstaaten einig sind.

The book analyses the position of the ECtHR which has been more and more confronted with criticism coming from the national sphere, including the judiciary. This culminated in constitutional court judgments declaring a particular ECtHR judgment non-executable, for reasons of constitutional law. Existing scholarship does not differentiate enough between cases of mere political unwillingness to execute an ECtHR judgment and cases where execution is blocked for legal reasons (mainly of constitutional law nature). At the same time, the discussion under EU law on national/constitutional identity limiting the reach of the former has been only loosely linked with the ECHR context. This book presents a new dogmatic concept - 'principled resistance' - to analyse such cases. In this book, Jack Goldsmith and Eric Posner argue that international law matters but that it is less powerful and less significant than public officials, legal experts, and the media believe. International law, they contend, is simply a product of states pursuing their interests on the international stage. It does not pull states towards compliance contrary to their interests, and the possibilities for what it can achieve are limited. It follows that many global problems are simply unsolvable. The book has important implications for debates about the role of international law in the foreign policy of the United States and other nations. The authors see international law as an instrument for advancing national policy, but one that is precarious and delicate, constantly changing in unpredictable ways based on non-legal changes in international politics.
