Earlier, daughter in a joint Hindu family had a right to sustenance, but not in the control and ownership of property. Daughters' right to equality has been recognized by the law by amending the Hindu Succession Act, 1956 by the laudable initiative taken inter alia by the then chief Minister of Andhra Pradesh and the recent amendment of 2005 by the central legislature. But, the law has not been effectively implemented inter alia due to the male chauvinism, lack of awareness among the daughters and the greedy attitude of the brothers. The Hindu Succession (Amendment) Act, 2005 -- which substituted Section 6 of the Hindu Succession Act, 1956 -- came into force on September 9, 2005. However, even after the amended law came into force and the judicial pronouncements are in favor of the Hindu daughter, the daughter has been still neglected at the first instance, in her own natal family and everywhere, because of blatant disregard and unjustified violation of these provisions. If there is no conscious exercise of the right by the people, particularly the daughters, there cannot be effective enforcement of the right created by the law. This paper analyzes the legal position and narrates a typical case study of the factors affecting the Hindu daughter's claim for the ancestral property.

This paper examines whether and to what extent amendments in inheritance legislation impact women's physical and human capital investments, using disaggregated household level data from India. The authors use inheritance patterns over three generations of individuals to assess the impact of changes in the Hindu Succession Act that grant daughters equal coparcenary birth rights in joint family property that were denied to daughters in the past. The causal effect is isolated by exploiting the variation in the timing of father's death to compare within household bequests of land given to sons and daughters in the states of Maharashtra and Karnataka. The analysis shows that the amendment significantly increased daughters' likelihood to inherit land, but that even after the amendment substantial bias persists. The results also indicate a robust increase in educational attainment of daughters, suggesting an alternative channel of wealth transfer.

Owning Land, Being Women enquires into the processes that establish inheritance as a unique form of property relation in law and society. It focuses on India, examining the legislative processes that led to the 2005 amendment of the Hindu Succession Act 1956, along with several interconnected welfare policies. Scholars have understood these Acts as a response to growing concerns about women’s property rights in developing countries. In re-reading these Acts and exploring the wider nexus of Indian society in which the legislation was drafted, this study considers how questions of family structure and property rights contribute to the creation of legal subjects and demonstrates the significance of the politico-economic context of rights formulation. On the basis of an ethnography of a village in West Bengal, this book brings the moral axis of inheritance into sharp focus, elucidating the interwoven dynamics of bequest, distribution of family wealth and reciprocity of care work that are integral to the logic of inheritance. It explains why inheritance rights based on the notion of individual property rights are inadequate to account for practices of inheritance. Mondal shows that inheritance includes normative structures of affective attachment and expectations, i.e., evaluatively-charged imaginaries of the future that coordinate present practices. These insights pose questions of the dominant resource-based conceptualisation of inherited property in the debate on women’s empowerment. In doing so, this work opens up a line of investigation that brings feminist rights discourse into conversation with ethics, enriching the liberal theory of gender justice.
