In the course of the early modern period, the capacity of European states to raise finances, wage wars, subject their own and far away populations, and exert bureaucratic power over a variety of areas of social life increased dramatically. Nevertheless, these changes were far less absolute and definitive than the literature on the rise of the "modern state" once held. While war pushed the boundaries of the emerging fiscal military states of the seventeenth and eighteenth centuries, rulers remained highly dependent on negotiations with competing elite groups and the private networks of contractors and financial intermediaries. Attempts to increase control over subjects often resulted in popular resistance, that in their turn set limits to and influenced the direction of the development of state institutions. Written in honour of the leading historian of war and state formation in the early modern Low Countries, Marjolein 't Hart, the chapters gathered in this volume examine the main drivers, beneficiaries and discontents of state formation across and beyond Europe in the early modern period.

where Jeremy Richardson, Albert Weale and Hugh Ward were excellent hosts at the Department of Government and Thomas Christiansen a very good roommate. Having included the UK as a country where decision processes were far less participatory (and thus ‘worse’ in my own view) than those in the Netherlands, I started doing my first interviews there, which were mainly intended to identify suitable case studies for research. But then I read a highly critical review of a book that had a similar topic as my study. The critique was that cases of hazardous waste siting cannot adequately be studied without understanding their national context. This made me decide to devote some attention to the legal context of hazardous waste siting in the three countries of interest (which is of course only a part of the national context) and its development through the years. The study of the UK system of environmental regulation and land use planning was not a simple issue, and I was warned various times (for instance by Andrew Blowers at the Open University) that the legislation was highly complex and easily misinterpreted. I felt personally touched by such warnings and decided that I should perhaps approach the UK system a bit less as an evil empire and maybe be a bit more ‘objective’ in my appraisals.

The right to equal treatment is undoubtedly one of the most fundamental human rights. As such, it can be found in international human rights treaties, in constitutions and in national legislation. In this book the principle of equality is analysed from different angles, bearing in mind the South African and Belgian experiences in this area. Firstly, a general overview is given of the different sources of human rights law in the Belgian and South African legal system, the relation between international and national law, the direct applicability and third party-applicability of rights and freedoms in the legal order(s), and the implementation mechanisms available both in Belgium and South Africa. Secondly, the principle of equality, as found in the Belgian Constitution, in the European Convention on Human Rights and in the South African Constitution, and the South African Antidiscrimination Bill are analyzed. Within democratic states, parliaments have always been regarded as playing a pivotal role in the creation of rules. Through its composition, parliament represents the opinions and interests of society, which it serves through the legislative process. But in an increasingly globalized world, nation-states are confronted with issues that require international cooperation, expert knowledge and flexibility to resolve. Rather than taking the lead, parliaments are increasingly settling for a managerial position and have begun to outsource their rulemaking powers (and other constitutional responsibilities) rather than exercising them themselves. Outsourcing Rulemaking Powers identifies the shared constitutional principles that determine the limits to the outsourcing of rulemaking powers. It asks fundamental questions of its readers, such as: which powers should be outsourced? And to whom? What mechanisms are in place to guarantee the quality of the rules they make? Through the examination of multiple countries, this book argues that there should be minimal legal safeguards to which all rules must heed, in particular those made by autonomous public or private actors. Offering a bridge between traditional constitutional law and transnational private law, this book will be of interest to both practitioners and scholars within the global communities of comparative constitutionalism, global administrative law and transnational private law.
