The election of both Urban VI and Clement VII to the papacy in 1378, by the same body of cardinals, presented the church with an apparently insoluble constitutional difficulty. Dr Swanson examines the reaction to this situation from a hitherto unconsidered perspective: that of the universities to whom Europe turned to formulate the theories which would solve the problem. He examines the attempts by the academics to gain support for their various schemes and shows how these produced conflict at various levels: locally, between factions within individual universities; nationally, between rival universities, and between universities and their ecclesiastical and secular superiors; and internationally, as the universities adopted mutually exclusive attitudes and sometimnes clashed with their own popes. The concluding chapters show how the academics finally devised the conciliarist formula which led to the convocation of the Council of Pisa in 1409.

This book offers perspectives on the legal and intellectual developments of the twelfth century. Gratian's collection of Church law, the Decretum, was a key text in these developments. Compiled in around 1140, it remained a fundamental work throughout and beyond the Middle Ages. Until now, the many mysteries surrounding the creation of the Decretum have remained unsolved, thereby hampering exploration of the jurisprudential renaissance of the twelfth century. Professor Winroth has now discovered the original version of the Decretum, which has long lain unnoticed among medieval manuscripts, in a version about half as long as the final text. It is also different from the final version in many respects - for example, with regard to the use of of Roman law sources - enabling a reconsideration of the resurgence of law in the twelfth century.

The texts edited in this volume deal with angelology and anthropology, and particularly with the nature and the functions of immaterial substances like angels and the human rational soul. Marchia discusses such controversial issues as universal hylomorphism, i.e., whether angels and the rational soul are composed of both matter and form (q.13), the immortality of the soul (qq. 18-19), and the nature and the object of the intellect and will (qq. 20,21), as well as the functionality of the angelic intellect - whether angels understand through discursive reasoning (q.23), and how they can speak with each other (q. 26). The problematic nature of the relationship between the material and the immaterial is approached through asking whether an angel can produce a material object (q.22) and whether a material object can be the source of an angel's understanding of that object (q.25).
