Do the dead have rights? In a persuasive argument, Don Herzog makes the case that the deceased’s interests should be protected This is a delightfully deceptive works that start out with a simple, seemingly arcane question—can you libel or slander the dead?—and develops it outward, tackling larger and larger implications, until it ends up straddling the borders between law, culture, philosophy, and the meaning of life. A full answer to this question requires legal scholar Don Herzog to consider what tort law is actually designed to protect, what differences death makes—and what differences it doesn’t—and why we value what we value. Herzog is one of those rare scholarly writers who can make the most abstract argument compelling and entertaining.

Draft Defamation Bill written by Great Britain: Ministry of Justice and has been published by The Stationery Office this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-03-15 with Law categories.

This consultation paper sets out the Government's proposals for reform of the law on defamation, aiming to achieve balance between protection of freedom of speech and the protection of reputation. The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.

Slandering The Sacred written by J. Barton Scott and has been published by University of Chicago Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-04-05 with Religion categories.

A history of global secularism and political feeling through colonial blasphemy law. Why is religion today so often associated with giving and taking offense? To answer this question, Slandering the Sacred invites us to consider how colonial infrastructures shaped our globalized world. Through the origin and afterlives of a 1927 British imperial law (Section 295A of the Indian Penal Code), J. Barton Scott weaves a globe-trotting narrative about secularism, empire, insult, and outrage. Decentering white martyrs to free thought, his story calls for new histories of blasphemy that return these thinkers to their imperial context, dismantle the cultural boundaries of the West, and transgress the borders between the secular and the sacred as well as the public and the private.

Sovereignty Rip written by Don Herzog and has been published by Yale University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-04-14 with Political Science categories.

Has the concept of sovereignty outlived its usefulness? Social order requires a sovereign: an actor with unlimited, undivided, and unaccountable authority. Or so the classic theory says. But without noticing, we’ve gutted the theory. Constitutionalism limits state authority. Federalism divides it. The rule of law holds it accountable. In vivid historical detail—with millions tortured and slaughtered in Europe, a king put on trial for his life, journalists groaning at idiotic complaints about the League of Nations, and much more—Don Herzog charts both the political struggles that forged sovereignty and the ones that undid it. He argues that it’s no longer a helpful guide to our legal and political problems, but a pernicious bit of confusion. It’s time, past time, to retire sovereignty.

Conservatism was born as an anguished attack on democracy. So argues Don Herzog in this arrestingly detailed exploration of England's responses to the French Revolution. Poisoning the Minds of the Lower Orders ushers the reader into the politically lurid world of Regency England. At once history and political theory, absorbing and disquieting, this book challenges our own commitments to and anxieties about democracy. Copyright © Libri GmbH. All rights reserved.

Talking To The Dead written by George Noory and has been published by Macmillan + ORM this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-10-11 with Body, Mind & Spirit categories.

Throughout history, people have sought ways to contact the dead and spirits. Such experiences challenge beliefs and often set people on a path of deeper exploration, looking for validation—and ways to have controlled, direct contact. Do spirit communication devices really work? What are the prospects of someday being able to pick up a cell phone or sit in front of a webcam and talk to the Other Side? While proof of contact is still elusive, there is an abundance of tantalizing evidence and experience to inspire people. For the past century, inventors have been inspired by the spirits themselves to create telephone, video, radio, and computers to attempt real-time, two-way communication with the dead and other entities. Talking to the Dead explores the colorful history and personalities behind spirit communications, weaving together spirituality, metaphysics, science, and technology. It examines the idea that new technology can connect to the ancient and universal wisdom of the "music of the spheres"; that contact with the spirit realms can be made through the vibrations of sound.
