What is public interest law? How effective is it? What are the limits to litigation as a mechanism for conflict resolution? In this study, economists, lawyers, and sociologists evaluate an institutional form that is new to American society and, indeed, to the world--the public interest law (PIL) organization. The book introduces the reader to the structure, resources, and activities of this "nonprofit industry," and also to the factors that affect PIL firms in their choices of cases and methods of handling them. The authors examine PIL's vast range of contemporary public policy concerns. These incude such general topics as the environment, consumerism, housing, employment discrimination, medical care, occupational health and safety, education finance, and taxation. A number of base studies are presented, and a method for economic analysis and evaluation is introduced and applied. The study points to PIL's success in advocating under-represented interests, in winning courtroom decisions, and in translating legal victories into reallocations of resources. At the same time, it notes the bias of PIL towards test-case litigation, a propensity to focus on judicial victories rather than on real social change, and a tendency to use lawyers even when other types of professionals might be more effective. Many of these problems stem from uncertainty of funding and legal restrictions on "nonprofit" organizations. The result is a set of hurdles that distracts PIL firms from their principal goals. The authors do not limit themselves to PIL, but comment on the effectiveness of legal instruments as devices for social change, and on the behavior of the voluntary nonprofit sector, a little-studied portion of the economy. In a world of growing public interest in global matters and criticisms of multilateralism to adequately address them, the role of international courts and tribunals in the resolution of disputes is shifting. This work is a quality analysis of the problems posed by Political Action Committees in American life. As the author notes in his new introduction: "Political corruption, as measured by campaign contributions of special interests to elected officials, increased significantly in the few years since the first publication of Capital Corruption. The number of PACs rose from 2,551 in 1980 to 4,175 by 1986. The percentage of PAC contribution of total campaign costs increased from 31.4 percent in 1980 to 41.9 percent (House) and 24.5 percent to 27.0 percent (Senate) in 1986." Such data only begin to tell the story of a book which has grown in stature during the decade. Etzioni characterizes Washington as a marketplace where deals are struck, where a special interest group can buy single pieces of legislation or long-run commitments or a whole slew of legislation. Because such purchases are not direct, but elliptical, they fall within the legal system, but for Etzioni, they are beyond the pale of moral or political worthiness. The book provides policy answers to vexing political dilemmas of mass politics today. This compelling book analyzes the rise of civil society and legal contentiousness in contemporary China. Scott Wilson examines how Chinese AIDS carriers and pollution victims, relying on weak laws and judicial institutions, pursue justice and protection of their rights in Chinese courts and civil society. In exploring the “politics of justice” in China, the author contends that civil society and legal rights advance when their organizers have support from pockets of the Chinese Communist Party, resources from international groups, and the backing of protesters. Even lawsuits that fail in the courts can raise societal consciousness of social issues and can lead to revised state policies to address the substantive claims of disadvantaged citizens. Underlying the politics of justice is the regime’s attempt to balance commitments to legal development and its interest in regime stability. Wilson argues that the Chinese state has looked more favorably upon pollution victims’ civil-society organizations and lawsuits than those of AIDS carriers. Going beyond the standard overviews of China’s legal system, Tigers without Teeth is unique in its close comparison of legal activism on two sensitive and politically relevant social issues. It provides important insights into the development of civil society, as well as highlighting limitations to the pursuit of justice as the system balances between the development of rule of law and regime stability.
