"La investigación parte del hombre individual y su destino, y aplica para su aprehensión el diagnóstico psíquico desarrollado en la psicología. Esto no representa una negación de la importancia de las investigaciones sociológicas que tratan de descubrir motivos sociales de la criminalidad. Más bien, se puede reconocer claramente la significación de factores sociales en las descripciones individuales de casos. Antecedentes sociales de la criminalidad no son, como tales, sin embargo, objeto de un procedimiento penal individual, que tenga que preocuparse del autor penal individual, sino que son objeto de investigación criminológica dirigida desde un punto de vista político-social (y con ello también político-jurídico). Al contrario, en el marco de esta investigación se trata del juzgamiento del individuo; para ello en el procedimiento penal —junto al informe social— solo puede aplicarse el diagnóstico psíquico. Esto surgirá con claridad del objetivo propuesto en forma central y, en primer lugar, con este trabajo: siempre que se quiera con los medios de la justicia penal impedir el deslizamiento en la criminalidad crónica, más alta será la chance para el éxito de la intervención jurídico-penal, cuanto más temprano se detenga “la carrera criminal”, porque entonces el proceso de consolidación está poco avanzado y todavía puede ser posible una reorientación. Con ello, le corresponde a la justicia penal juvenil una significación decisiva dentro del conjunto de los esfuerzos penales para evitar la criminalidad posterior. Por eso, en el procedimiento penal juvenil, en el fondo, siempre se requiere una postura indicativo-educativa". Hilde Kaufmann.
