La obra que tiene en sus manos constituye una necesaria puesta al día y asume la tarea de analizar todos los requisitos típicos que componen la figura del fraude funcionarial, prevista y sancionada por el recientemente modificado artículo 436 del Código penal español, conforme LO 1/2015, de 30 de marzo. Este ilícito integra los denominados delitos contra la Administración pública, razón por la que se aborda también el estudio de la Administración pública como institución, su papel actual y la delimitación del bien jurídico protegido, explicando para ello la relación existente entre Administración pública, función pública y, correcto ejercicio de esta última en pos de la satisfacción de intereses generales de los ciudadanos. Este riguroso pero a la vez sintético análisis integral permite al lector comprender en qué casos estaremos frente a un delito de fraude del funcionario público, cuáles son sus antecedentes normativos y su naturaleza jurídica, el carácter especial de este título de imputación y, las posibles relaciones intraneus - extraneus en torno a esta figura delictiva. Se trata de ofrecer de manera clara, compendiada y atendiendo a la doctrina y jurisprudencia recientes, la información que el usuario requiere sobre los límites objetivos y la configuración subjetiva de este tipo penal, sus fases de desarrollo y si procede o no el castigo por una tentativa de fraude, distinguiendo su aplicación de otras figuras delictivas, esto es, posibles problemas concursales.
