El legislador chileno, hasta la fecha, no ha consagrado un título o párrafo específico, dentro del articulado del Código Penal, destinado, específicamente, a tipificar los delitos económicos. Frente a ello –plantea la autora– surge la necesidad de establecer, por un lado, si los delitos regulados en la legislación penal chilena y, dentro de ellos, las estafas y otras defraudaciones, constituyen delitos propiamente económicos en tanto afectan el orden económico, y, por el otro, si afirmar que un delito sea económico tiene consecuencias relevantes para la interpretación y aplicación práctica de los delitos que puedan calificarse de tales. De esta manera, la obra busca proporcionar una herramienta de apoyo en la adquisición, actualización y/o profundización de conocimientos sobre los delitos económicos de estafa y otras defraudaciones. En la primera parte, el estudio se aborda desde un análisis introductorio, analizando el empleo de los términos “defraudación”, “estafa” y “fraude” en nuestra legislación, los que no siempre coinciden con el empleo doctrinal o jurisprudencial; tipificación en la legislación penal y principales modificaciones legales introducidas a las estafas y otras defraudaciones, entre otros tópicos relevantes. La segunda parte enuncia de manera ordenada los principales aspectos relativos al delito de estafa, estafas genéricas de los artículos 468 y 473 del Código Penal, entregas fraudulentas, estafas con causa ilícita, obtención fraudulenta de prestaciones estatales o fraude de subvenciones, fraude o estafa de seguros, y, por último, aborda la estafa-falta en el ordenamiento jurídico-penal chileno. La tercera parte se refiere a otras defraudaciones, específicamente al delito de apropiación indebida, y la cuarta parte desarrolla y expone las normas generales relativas a la determinación e imposición de la pena y las relaciones concursales entre el delito de estafa y los delitos de robo, fraude al Fisco, falsificación de instrumento privado y giro fraudulento de cheques. Contiene: Glosario, Preguntas y respuestas y Bibliografía.
