Premised on the Hobbesian conceptualization of law as the command of the sovereign, this paper traces the resilience of this conceptualization through to the modern democratic states. It looks at the change of the sovereign from an individual to an office and now the diffusion of power through different systems of checks and balances instituted by the modern political system of democracy. In doing this, the paper answers the question; to what extent is law the reflection of the wishes of political elites in a society? It explores the sources of law and the role of law as an organizing agent with a view of exposing the resilience of the political elite’s interests in law and in the use of law. The paper finally concludes that despite the changing nature of political systems, political elites have been able to preserve the law as a tool at their service. They have used their law making power to express their wishes in the law as well as used the complex procedural nature of law with several actors involved to serve their interest.

Argues that South Africans, like everyone else, need democracy for a more equal society What are democracies meant to do? And how does one know when one is a democratic state? These incisive questions and more by leading political scientist, Steven Friedman, underlie this robust enquiry into what democracy means for South Africa post 1994. Democracy is often viewed through a lens reflecting Western understanding. New democracies are compared to idealized notions by which the system is said to operate in the global North. The democracies of Western Europe and North America are understood to be the finished product and all others are assessed by how far they have progressed towards approximating this model. Power in Action persuasively argues against this stereotype. Friedman asserts that democracies can only work when every adult has an equal say in the public decisions that affect them.Democracy is achieved not by adopting idealized models derived from other societies–rather, it is the product of collective action by citizens who claim the right to be heard not only through public protest action, but also through the conscious exercise of influence on public and private power holders. Scholarly debate on the subject of global justice has been overwhelmingly focused so far on the socio-economic aspects of justice. Much less attention has been given to those political aspects of global justice concerned with arrangements for public decision-making and the collective exercise and control of power. This gap is not adequately filled by literatures on global democracy, either, since these do not incorporate sufficient analysis of whether the democratic institutions that deliver political justice within states can achieve the same result when dealing with the very different forms of power and political agency that structure the domain of global politics. This collection brings together scholars from across the disciplines of political theory, normative ethics, and International Relations to undertake a fresh examination of some fundamental theoretical questions about the nature and significance of global political justice.
