In 2006, the United States Sentencing Commission1 undertook a review of the impact on federal sentencing of the Supreme Court's decision in United States v. Booker.2 In March 2006, the Commission published the results of that review in the Final Report on the Impact of United States v. Booker on Federal Sentencing.3 As part of that report, the Commission performed an analysis of data from the federal courts to examine whether differences in the length of sentences imposed on offenders were correlated with demographic characteristics of those offenders. Based on continued interest in this issue, and in response to specific requests to update its prior analysis, the Commission has now repeated the analysis used for the Booker Report with additional data and has also developed a second methodology to examine that data. This report presents the results of that work. This report focused on three separate time periods which together spanned the time between May 1, 2003, and September 30, 2009. The Commission found a correlation between the length of sentences imposed on some groups of offenders and the demographic characteristics of those offenders. These differences were not present in all time periods under study and differed in magnitude in the time periods in which they were observed.

This 2-year study compared the treatment of white and minority offenders at key decision points in the criminal justice processing of approximately 1,400 male prison inmates in California, Michigan, and Texas. Study data came from the California Offender-Based Transaction Statistics which tracks offender-processing from arrest to sentencing, and the Rand Inmate Survey which yielded data from self-reports of approximately 1,400 male prison inmates in California, Michigan, and Texas. Prior research on discrimination in the criminal justice system produced controversial and contradictory findings. Section II discusses the problems with this research and briefly describes the data and methodology. Section III describes the workings of the criminal justice system and identifies racial differences in case-processing revealed in some of the data. Section IV analyzes more of the data for racial differences in crime-commission rates and the probability of being arrested. Section V looks at racial differences following the imposition of a court sentence. Section VI explores racial differences in offender characteristics, specifically: crime motivation, weapon use, and prison violence. Section VII summarizes the findings and presents the conclusions of the study. Although the case-processing system generally treated offenders similarly, there were racial differences at two key points. Minority suspects were more likely than whites to be released after arrest; however, after a felony conviction, minority offenders were more likely than whites to be given longer sentences and to be put in prison instead of jail. There were no statistically significant differences that implied discrimination against minorities in corrections.

Looking back, America has seen its fair share of differences among its population, so it should not come as a shock that sentencing disparities are a serious criminal justice issue in the United States. Each year, thousands of people are sent to Federal prisons where they receive sentences for crimes they have been convicted of committing. The United States Sentencing Commission publishes these results annually. No matter the number of persons entering the prison system on the federal level, the number of female offenders often remains about the same (8555 in 2000; 9451 in 2007; and 9302 in 2008). While it is illegal to openly discriminate against a defendant and give them a sentence based on his or her demographics, the laws are written in ways where discrimination can still be allowed. The current research examines the relationship between not only gender, but also looks to education, race, age, and the crime committed to explain this gap in sentencing. Methodology: The data for the current research are from the United States Sentencing Commission (USSC), an annual report comprised of details for every person who entered federal prison in the given year. The current research used data from the year 2016 and includes 67,660 cases. Findings: Findings are supportive of previous research. Whether or not a defendant will receive a sentence is influenced by gender, age, race, education, and offense type. Sex, race, and education also affected the length of the sentence received. Unlike previous studies, age did not appear to be significant when determining the length of a sentence.
