Die Mitglieder des Deutschen Bundestages werden direkt vom Volk gewählt. Können sich die Wahlberechtigten „ihre“ Bundestagsabgeordneten auch nicht frei aussuchen - müssen sie doch auf Grundlage der von den Parteien getroffenen Vorauswahl der Kandidaten ihre Entscheidung fällen - sind die direkten Möglichkeiten, auf die Zusammensetzung des Bundestages Einfluss auszuüben, deutliche höher als bei der zweiten Kammer der bundesdeutschen Legislative - dem Bundesrat nämlich: Letzten Endes sind die dortigen Repräsentanten die Abgesandten einer Regierung, die von einem Ministerpräsidenten gebildet wurde, der wiederum von einem weiteren zwischengeschalteten Gremium - den Landtagen - gewählt wurde. Dieser höheren Legitimität des Bundestages aufgrund der Direktwahl durch das Volk wird mit dem größeren Einfluss im Gesetzgebungsverfahren Rechnung getragen. Im Kern der Gesetzgebung besitzt der Bundestag die höchsten Gestaltungsmöglichkeiten und Kompetenzen was Bundesangelegenheiten angeht. Im neuen Jahrtausend gewinnt Politik in ihrer unmittelbaren Auswirkung auf die Menschen eine immer stärkere europäische Dimension. Europa war noch nie so gegenwärtig in den politischen Entscheidungsprozessen wie heute, gerade in den Kernbereichen Handel, Wirtschaft und Agrar. Diese logische Folge einer fortgesetzten europäischen Integration und die zunehmende Übertragung von Entscheidungskraft auf europäische Institutionen eröffnet ein Problemfeld: Verstärkt werden damit auch Kompetenzen der Legislative des Bundes auf die höhere Ebene der Europäischen Union verlagert, und damit dem offenbar am stärksten legitimierten Gremium der bundesdeutsche Gesetzgebung entzogen. Stattdessen werden die Entscheidungen für Europa, die letzten Endes auch jeden einzelnen Bürger betreffen, überstaatlich von weitaus weniger direkt vom Volk legitimierten Institutionen getroffen, etwa vom Ministerrat oder der EU-Kommission. Es stellt sich die Frage, welchen Einfluss die Einbettung des Bundestages in den europäischen Kontext auf seine Kompetenzen hat, oder kurz: Welche Mitwirkungs- und Gestaltungsmöglichkeiten bestehen für den Deutschen Bundestag bei den Entscheidungen für und in Europa und welche Bedeutung hat die europäische Dimension für die Arbeit des höchsten deutsche Parlamentes?

This book is the first monograph-form legal study on multilevel governance in the EU and represents a radical change in the approach to this topic. Particularly after the Treaty of Lisbon’s entry into force, research on multilevel governance can no longer remain confined to the analysis of political dynamics or of soft law arrangements. Multilevel governance emerges as a constitutional principle in the European constitutional space, envisaging a method of governance based on the strong involvement of sub-national authorities in the creation and implementation of EU law and policy. Its foundation is in the mosaic resulting from the constitutional systems of the Union and its Member States. Multilevel governance arrangements play a fundamental part in achieving key Treaty objectives (such as subsidiarity, respect for the national identities of the Member States including regional and local self-government, openness, and closeness to the citizen). These arrangements lend legitimacy to EU decision-making, while also promoting constitutionalism and democracy in the EU.

The process of European integration is marked both by continued deepening and widening, and by growing evidence of domestic disquiet and dissent. Against this background, this volume examines three key themes: the challenge to the power of member states - as subjects of European integration - to determine the course of the integrationist project and to shape European public policies; the increasing constraints in the domestic political arena experienced by member states as objects of European integration; and the contestation over both the 'constitutive politics of the EU' and specific policy choices. These three themes - power, constraint and contestation - and their interdependence are explored with specific reference to contemporary Germany. The main findings call for a revision of the 'conventional wisdom' about Germany's Europeanization experience. First, while Germany continues to engage intensively in all aspects of the integration process, its power to 'upload' - 'hard' and 'soft', 'deliberate' or 'unintentional', 'institutional' or 'ideational' - appears in decline. Germany's capacity to 'shape its regional milieu' is challenged by both changes in the integration process and the ever more apparent weaknesses of the 'German model'. The traditional regional core milieu is shrinking in size and importance in an enlarging Europe, and Germany's milieu-shaping power is being challenged. Second, the coincidence of enabling and constraining effects is being progressively replaced by a discourse that notes unwelcome constrictions associated with EU membership. The book's findings suggest that key political institutions and processes in the Federal Republic have not co-evolved with the integration process, but lead an, at times, uncomfortable co-existence. Third, domestic contestation over both everyday EU policy and the constitutional politics of integration seems set to increase. There are, as yet, no indications that these domestic conflicts will reach an intensity comparable to that of the 1950s. However, both the 'permissive' mass consensus and, perhaps more importantly, élite consensus are being tested to their limits. This volume is essential reading for students of comparative European politics and German studies.

This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law.
