Ernst Fraenkels 'Doppelstaat' ist ein Standardwerk über die Politik, die Justiz und das Recht im Nationalsozialismus. Fraenkels These ist, dass im Nationalsozialismus zwei Formen der Herrschaft nebeneinander bestehen: Im "Normenstaat" gelten die bisherigen Rechtsvorschriften in dem Umfang weiter, wie es zur Funktionsfähigkeit des fortexistierenden kapitalistischen Wirtschaftssystems erforderlich ist. Im "Maßnahmenstaat" wird nicht nach rechtlichen Regeln, sondern nach Kriterien politischer Opportunität entschieden, um die Herrschaft des Regimes zu sichern und um seine spezifischen Ziele – wie die Judenverfolgung - durchzusetzen. Im Zweifel entscheidet der Maßnahmenstaat nach seinem Interesse, ob eine Angelegenheit nach den Regeln des Normenstaates oder nach den Bedürfnissen des Maßnahmenstaates behandelt wird. Das Buch fand seit Mitte der siebziger Jahre in der wissenschaftlichen Literatur und der Publizistik eine breite Resonanz. Der "Doppelstaat" erreichte den Rang eines Klassikers.

Die Auswahl dieser beiden Werke liegt darin, dass ich sie für die ersten beiden relevanten Auseinandersetzungen mit dem Nationalsozialismus halte und sie während der Zeit des Nationalsozialismus entstanden sind. Der Doppelstaat geht auf die Zeit bis 1938 zurück und kann als Phase eins oder Friedensphase bezeichnet werden. Behemoth hingegen ist die historische Fortentwicklung und wird in meiner Arbeit als Phase zwei oder als Kriegsphase gesehen: „Unter dem Eindruck der Vorbereitung und Durchführung des Krieges erweiterte sich der Maßnahmenstaat zu dem alles verschlingenden Unstaat, den Franz Neumann mit dem Namen des alttestamentarischen Ungeheuers Behemoth kennzeichnete.“

As the Nazis staged their takeover in 1933, instances of antisemitic violence began to soar. While previous historical research assumed that this violence happened much later, Hermann Beck counteracts this, drawing on sources from twenty German archives, and focussing on this early violence, and on the reaction of German institutions and the elites who led them. Before the Holocaust examines the antisemitic violence experienced in this period - from boycotts, violent attacks, robbery, extortion, abductions, and humiliating 'pillory marches', to grievous bodily harm and murder - which has hitherto not been adequately recognized. Beck then analyses the reactions of those institutions that still had the capacity to protest against Nazi attacks and legislative measures - the Protestant Church, the Catholic Church, the bureaucracies, and Hitler's conservative coalition partner, the DNVP - and the mindset of the elites who led them, to determine their various responses to flagrant antisemitic abuses. Individual protests against violent attacks, the April boycott, and Nazi legislative measures were already hazardous in March and April 1933, but established institutions in the German State and society were still able to voice their concerns and raise objections. By doing so, they might have stopped or at least postponed a radicalization that eventually led to the pogrom of 1938 (Kristallnacht) and the Holocaust.

Citizenship was the most important mark of political belonging in Europe in the twentieth century, while estate, religion, party, class, and nation lost political significance in the century of extremes. This is shown by examining the legal institution of citizenship, with its deciding influence on the limits of a political community, on inclusion and exclusion. Citizenship determined a person's protection, equality, and freedom and thus his or her chances in life and very survival. This book recounts the history of citizenship in Europe as the history of European statehood in the twentieth and early twenty-first centuries. It does so from three vantage points: as the development of a legal institution crucial to European constitutionalism; as a measure of an individual's opportunities for self-fulfilment ranging from freedom to totalitarian subjugation; and as a succession of alternating, often sharply divergent political regimes, considered from the perspective of their inclusivity and exclusivity, and its justification. The European history of citizenship is discussed in this book on the basis of six selected countries: Great Britain, France, Germany, Czechoslovakia, Poland, and Russia. For the first time, a joint history of citizenship in Western and Eastern Europe is told here, from the heyday of the nation state to our present day, which is marked by the crises of the European Union. It is the history of a central legal institution that significantly represents and at the same time determines struggles over migration, integration, and belonging. One of the central concerns of this book is what lessons can be learned when it comes to the future chances of European citizenship.
