English summary: Throughout the world, international property law is governed by the principle that the rights to an object are subject to the law of the state in which the object is located at the decisive point in time. The increasing smuggling of cultural property has led to a reconsideration of this principle. There is a modern view which is in favor of placing more emphasis on the cultural and legal connection between cultural property and its country of origin. Volker Wiese describes the influence of the European Council directive 93/7/EEC, which deals with the return of cultural objects unlawfully removed from the territory of a member state, on the international private law pertaining to cultural property. In doing so, he focuses on the boundaries of a possible exertion of influence. In the author's opinion, lawmakers in Germany have failed to recognize these effects and have implemented the directive incorrectly. He points out the significance of this incorrect implementation for Germany's possible entry into the UNESCO Convention of 1970. German description: Weltweit wird das Internationale Sachenrecht von dem Grundsatz beherrscht, dass Rechte an einer Sache dem Recht des Staates unterliegen, in dem sich die Sache in dem fur die Anknupfung massgeblichen Zeitpunkt befindet (sog. lex rei sitae -Regel). Insbesondere der zunehmende Schmuggel von Kulturgutern hat in diesem Bereich in jungster Zeit zu einem Uberdenken dieses Grundsatzes gefuhrt. Befurwortet wird, die kulturelle und rechtliche Verknupfung eines Kulturguts mit seinem Herkunftsland starker zu betonen (sog. lex originis -Regel). Volker Wiese beschreibt, welchen Einfluss die europaische Richtlinie 93/7/EWG uber die Restitution illegal verbrachter Kulturguter, die eingehend vorgestellt wird, auf das Internationale Sachenrecht der Kulturguter genommen hat. Starkes Gewicht legt er dabei auf die Grenzen einer moglichen Einflussnahme. Diese Grenzen, die sich etwa aus der europaischen Eigentumsgarantie und der Warenverkehrsfreiheit ergeben, sind kaum zuvor beschrieben worden. Die Ergebnisse der Untersuchung stehen deshalb zum Teil im Widerspruch zur derzeit herrschenden Meinung. Schliesslich vertritt der Autor die These, dass der deutsche Gesetzgeber diese Auswirkungen verkannt und die Richtlinie fehlerhaft umgesetzt hat. Abschliessend weist er auf die Bedeutung dieser fehlerhaften Umsetzung fur einen moglichen Beitritt Deutschlands zur UNESCO-Konvention von 1970 hin.

This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience. In addition to detailed treatment of the law in Austria, England and Wales, France, Germany, Hungary, Italy, the Netherlands, Norway, Poland, Scotland, and Spain, the book also has chapters on Australia and New Zealand, South Africa, the United States, Canada, the countries of Latin America, and the People's Republic of China. Some other countries are covered more briefly, and there is a separate chapter on Islamic law. Intestate Succession is the second volume in the Comparative Succession Law series which examines the principles of succession law from a comparative and historical perspective. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets.
